The Proposed D.C. Law Challenging use of Discriminatory AI Algorithms
Laura M. Moy, Associate Professor of Law at Georgetown University Law Center and Director of the Communications & Technology Law Clinic, explains the proposed D.C. law holding companies accountable for using discriminatory AI algorithms in evaluating applicants for jobs, housing, or other similar opportunities. The moderator for this podcast is Don Allen Resnikoff.
The proposed legislation would prohibit companies from using artificial intelligence algorithms that produce biased or discriminatory results. Biased or discriminatory results cause harm by blocking people from opportunities such as jobs or housing.
Ms. Moy explains that companies that use algorithms in their decision making would be required by the proposed law to, among other things, audit their algorithms for discriminatory patterns, and disclose and explain when algorithms negatively affect an applicant’s opportunities. The proposed law would empower the AG’s office and individuals to bring suit for violations.
Ms. Moy argues that the proposed law is needed to protect applicants’ rights. She also addresses some arguments raised in opposition. Opponents argue that there is already law in existence making discrimination illegal, so that a supplemental anti-discrimination law focused on algorithms is not needed. Also, opponents argue that language in the proposed law is complex and unclear, causing uncertainty for companies using algorithms.

Civil Rights and Nonprofits
Since our nation’s founding, nonprofits have played a major role in civil rights. In fact, the first nonprofit formed in the United States was devoted to help the enslaved. Nonprofits have been pushing the status quo ever since, and the status quo has pushed back, sometimes vigorously. Which raises the question: do nonprofits themselves have civil rights?
The hosts of this podcast are college classmates who pursued careers in law, civil rights, and nonprofits. Danielle R. Holley is the dean of Howard Law school, and Alex Reid is partner and national leader of BakerHostetler’s tax exempt and charitable giving team.

Hazardous Rail Shipments in Densely Populated D.C.
This podcast describes past local government efforts to keep hazardous freight rail traffic out of D.C. and illuminates what DC government is doing now to protect D.C. citizens, using current laws and regulations.
In 2005, the D.C. Council was blocked by the D.C. Court of Appeals from enforcing legislation that would have stopped rail transport of hazardous freight into DC. In 2007 a government report suggested routing rail freight traffic away from densely populated D.C., but that suggestion was not followed.
In this podcast, Michael Somersall, Associate Director of the Rail Safety and Emergency Response Division of D.C.’s Environmental Services Administration describes how this Division enforces current state level and federal rail safety rules and regulations with the goal of protecting District residents and railroad employees from unsafe practices on both freight and passenger trains. Ann Wilcox and Don Resnikoff provided introductory information. Ann is co-chair of the D.C. Bar D.C. Affairs Community. Don Resnikoff, who moderated the podcast, is a member of the D.C. Bar Antitrust and Consumer Law Community.

Sunshine for Consumers: How Proposed DC Law can Limit Court Secrecy Orders about Dangerous Products
Public access to judicial records is important. That is especially important in cases that have effects beyond the parties to the case—in particular, cases that involve defective products or dangerous environmental conditions that pose dangers to the general public. That principle is ignored when a court agrees to the parties’ request to hide those dangers from the public, by allowing overbroad confidentiality clauses in settlement agreements, or by issuing overbroad protective orders.
In conversation with Don Resnikoff, Naomi Claxton explains the need for public access to judicial records, and the need for laws that restrict overbroad confidentiality clauses in court-approved settlement agreements, and overbroad court-ordered protective orders. She explains that the proposed DC “Sunshine in Litigation Act of 2022” is such a law.

A Cautionary Tale on the Interplay of Sovereign Immunity and International Arbitration
At the center of Process & Industrial v. Nigeria is a multibillion-dollar arbitration award issued in 2015 in London. In the years since, protracted court proceedings over the fate of this award have unfolded on three continents. The latest phase of this saga required the D.C. Circuit Court to weigh in on how Nigeria's agreement to the New York Convention interplays with its sovereign immunity defense. In this episode, Mike Ehrenstein, a trial lawyer with experience representing sovereigns in these kinds of cases, and Kiran Nasir Gore, an international arbitration expert, discuss the clash between international dispute resolution and public policy. They touch on hot topics, including best practices for handling corruption and fraud allegations, policy concerns raised by arbitral awards that imply the fate of taxpayer dollars, and the future of the sovereign immunity defense.

The Penguin Random House and Simon & Schuster merger: There Goes the Book Industry?
The Department of Justice's antitrust trial to block the merger of Penguin Random House and Simon & Schuster has shaken up the book industry. A survey released by the Association of American Literary Agents indicated that 87% of respondents oppose, citing, among their chief concerns, that the deal would result in “less competition” for titles and “lower advances.” This landmark trial may not only predict the future of the book industry, but it is also offering many insights on how that industry operates. In this podcast, John Maher, Editor at Publisher's Weekly, discusses with entertainment industry lawyer, Kirk Schroder, about John's coverage and insights thus far about this trial. This podcast will be helpful for anyone who is connected to the book industry.

What You Need to Know About USPTO Expungements, Reexaminations and the Trademark Modernization Act
Over the past few years, record numbers of trademark applications have been filed, causing concerns about the integrity of the U.S. trademark registry and the value of the highly-sought-after U.S. trademark registration. In response, Congress passed the Trademark Modernization Act in December of 2020, which gave the USPTO one year to implement new proceedings called "expungement" and "reexamination." These new procedures came into effect on December 18, and allow third-parties to provide evidence that a registered trademark was not in-use when the applicant said it was, thus canceling the existing registration.
Our guest, Eric Perrott, is a Trademark attorney in D.C. and was the first attorney to file a "petition for expungement" against a trademark registrant that used a doctored stock image in its trademark application. We will discuss with him the implications of this development for brand owners and trademark attorneys, particularly international filers who will need to hire a U.S. based attorney to respond to these proceedings.
