9-7 The Buncombe Bastille Breakout Jail facilities and the ways of incarcerating people have steadily changed over the years in the Blue Ridge Mountains. Western North Carolina is no exception. From stocks in the town square of Asheville (“Morristown”) To more modern facilities that were, at the time, the best that money could build. The Buncombe co. In its many constructions, Jail has, at times, been full of criminals, both State and federal, some of whom were men of means and Influence. Men who could afford outside help to make their escape. Or at least make it a matter of more than a mere possibility. This shade of blue story is about a forgotten 1886 escape from one of the previous jails in Buncombe County.

9-6. The man who fell from the sky Seven o’clock in the morning of September 11, 1985, Fred looked out the window of his Knoxville, Tn. home and saw something strange in his driveway. Instead of finishing making his coffee, Fred went out to investigate. What Fred found would affect law enforcement locally and nationally for years—pointing at individuals in the DEA, CIA, the Governor’s Office, and possibly the White House. December 1927. Santa, followed by a group of local children, walked to the First National Bank of Texas. He entered the bank, leaving the children outside, accompanied by three large Elves. Greetings of “hello Santa” met with a shouting Santa telling everyone to “grab some sky” in a less than jolly tone. This started shootings, manhunts, car chases, and injuries. A total of eight were wounded. Including Santa and his stealing elves, six men would end up dead. Finding themselves on the ultimate Naughty or Nice list. The lady in the Georgia Creek Three days before the fourth of July celebration of 1885, a gentleman crossed a bridge over Milk Creek near Dalton, Georgia was confronted by a young boy pointing out a body in the creek. They pulled the body to shore and notified the authorities. An inquest was held. The coroner found she had two deep wounds in her skull. The young lady's brain was still oozing from two head wounds. The lady was a stranger to Dalton. Who was she? Who Killed her and why? Was justice found in the courts or at the end of a rope by an angry crowd? 8- 25. JESSE JAMES BAILEY- lawman extraordinaire who served as sheriff of two different North Carolina Countries in the 1920s.  Former Detective for Southern Railway, a celebrated humorist and storyteller, and a feared moonshine still wrecker. Bailey worked in several capacities for the railroad for 52 years until his retirement at age 70 in 1958. He took two leaves of absence of two years each in 1920 and 1928 when he was elected sheriff first of Madison and then Buncombe County, NC. The only lawman in the state to serve as sheriff in two counties. Bailey was born near Bailey's Bend on the French Broad River in Madison County. He was a farm boy until his telegrapher's job at Bailey Station in the Knoxville, Tenn., division of Southern Railway in 1906. 8-22. Clinton Smith, 1996 Kool-Aid killer? Clinton Smith was sentenced to death over 26 years ago in Halifax County, North Carolina. He was tried for killing his 6-year-old daughter, Brittany, with pesticide-laced Kool-Aid in 1996.  Brittany’s brother and sister survived. He has denied poisoning the children. Did he do it?  Did the District Attorney make insulting jokes about the defense’s expert witness during the trial?  Is there more evidence not covered in Court? What did the appeals say? 8-21 Cases of mistaken identity. Mistaken identity, in general, is not a big deal. But in cases that depend on the identification of a person, determining a person's liability, responsibility, and even freedom is very serious. Michael Carneal was 14 at the time of the school shooting in 1997. He shot and killed 3 students and wounded five others in a Kentucky high school shooting. Carneal now 39, told parole board members last week that he would live with his parents and continue his mental health treatment if they agreed to release him. Update on the September bonus episode of the Felon File Podcast. The Heath High School shooter's parole hearing on if he will be allowed to return to society and the public.  It will be Monday, September 26, before we know if Michael Carneal will be paroled or remain behind bars. The hearing decision was deferred until Sept. 26.   After serving 25 years of his life sentence, Carneal is now eligible for parole. Despite questioning Carneal for more than an hour,   the two parole board members in charge of his hearing could not reach a unanimous decision. What comes next for Carneal has the attention of not just McCracken County but the nation. He's one of the first convicted school shooters to be eligible for parole. Sept-18-Bonus. Is 25 enough?  14-year-old freshman student Michael Carneal said he had been called names and bullied by fellow students. He was  diagnosed with anxiety, depression, and severe paranoia. December 1, 1997, Michael Carneal wrapped a shotgun and a rifle in a blanket and took them to school, passing them off as an art project he was working on. He carried a loaded Ruger MK II .22-caliber pistol in his backpack. He rode to school with his sister, arriving; he inserted earplugs and took the gun out of his bag. Then, during a before-school prayer meeting, He fired ten rounds quickly at a  group of students. The Bunch Gang of the early 1930s.  Clarence Bunch was born in Claiborne County, Tennessee on August 11, 1911, to Hugh and Mattie Bunch of the Bunchtown community. His photographs show him to have been a clean-cut young man, clean-shaven and with a pleasant look on his face. Looks can be deceiving. The Gang's escapades started around 1933 when Bunch was involved in a bank robbery in Virginia. By 1934, his name and reputation had become well-known throughout the East Tennessee region. The young woman went slowly, as she had been crippled by meningitis when she was younger. She lived nearby with her parents near the town of Weaverville. At 11:30 that day, she was attacked. Shoved to the roadway by a large man. He dragged her into the roadside woods and assaulted her. After the assault a crowd formed, looking for a suspect. Finding one, the mob acted. Was it justice? A shade of blue story that starts at Muddy Creek in Forsyth County North Carolina. Or perhaps it ends there. A very popular fishing location at the time and still is by some accounts. Two local men on the 25th of August 1914 while fishing discovered something in the water that would impact a family for decades. 15 feet from the bank the object hung on the surface of the water. One of the men doing what comes naturally, he poked it with his fishing pole.  Unfortunately, the object stirred and shifted in the water revealing a dead man's naked body. 7-19. 1859, Missing Girl, Missing Body. Murder? A missing girl. Suspicions of murder. the body never found. A prominent Rockingham County NC  farmer,  hanged for her murder in 1860. A precedent-setting case in North Carolina law. It allowed the state to convict a person of murder without there being a corpus delicti  better known as the body of the victim It was Dec. 1, 1859, when Peggy was last seen by her family; approximately a year later a  farmer hung for her death. 7-6. The day they hung Santa. December 1927. Santa followed by a group of local children walked down the street heading to the First National Bank. Leaving the children outside but accompanied by three men he walked into the bank. On May 31, 2003,  FBI Top Ten Fugitive Eric Robert Rudolph was arrested by North Carolina police officer J.S. Postell. While on patrol he located Rudolph dumpster diving behind a grocery story in Murphy, North Carolina. The victim was  raped, beaten, stabbed and set on fire on March 30, 1991. Her daughter was three at the time. Wayne Williams is now serving a life sentence after being convicted for two of the murders. Episode s2-9- The Pennsylvania Turnpike Phantom of 1953. On the night of July 25. Lester Woodward, a 30 year old freight driver did what freight drivers have been doing for 1000s of years. He got tired and pulled his vehicle over to get some sleep. Hauling freight is an old profession. The methods of doing it have evolved but its still a matter of moving goods from one place to another. Lester had no reason to think it would be a problem, he had been doing it for years.  Unfortunately Lester never woke up. He was shot once. With .32 caliber pistol. The bullet going straight into his brain. This was the first attack of the murder named the Turnpike Phantom. Episode S2-7- A 15 day snow storm, domestic violence, & national attention to a small town in Mtns. of N.C. A fifteen-day severe weather snow storm struck the east coast in1881.   It became the prequel to a fatal domestic violence incident in McDowell Co. North Carolina. Episode S2- 4- The Buncombe County Smith Cold Case Scheduled for September 14, 2019 at 7:00 PM 1997,  A man and his son are looking for deer tracks in North Carolina's Pisgah National Forest. Instead of deer sign they came across human bones, clothing, and other items scattered in the woods near a primitive campsite.   The remains, were centered around a shallow grave. The grave of a murdered woman.   Investigation found the body to be of a Pennsylvania  missing person, Judy Smith.  Today the murder investigation has never been solved. Episode S2-3-  The Murder of 3 year old Lillian Patrick Three year old Lillian Patrick's step father John Gibson, lived with his eighteen-year-old wife; her three-year old daughter from a previous marriage Lillian. Gibson's 16 year old brother Henry .   In late November 1900, an anonymous person informed the city health Inspector-Doctor that the Gibson stepdaughter was suffering from smallpox. When the Dr. went to the Gibson house to investigate, he found the three year old dying, but not of smallpox. Instead of a contagious disease a fatal case of sever child abuse was located. Episode s2-2- 160 years ago a Congressman shot & killed the son of Francis Scott Key near the white house and witnesses In April of 1859, New York Congressman Daniel Sickles became the first person in history to ever be acquitted of a crime due to temporary insanity. The crime in this case was the  murder of Philip Barton Key II, the son of Francis Scott Key, author of “The Star-Spangled Banner,” the national anthem of the United States. Sickles approached Key in DC’s Lafayette Square — a short distance from the White House –and shot him in the groin. “You villain, you have dishonored my house, and you must die!” Sickles reportedly said. Episode -20- The Right Rev. George Washington Carawan and the school teacher Charles  Lassiter. 1852. Though a preacher of the gospel, The Reverend George Washington Carawan, was a  prominent and powerful North Carolina Baptist minister. A man of violent temper and strong animal passions, more likely to inspire terror than piety in the community and those around him.  The sorrows he begat in his relationships would follow him to the courtroom for a final tragic act in Carawan’s play of tragedy, life and death. Dump choices?  Thinking himself smarter than every one else? Or did his luck run out?  Perhaps. several issues came together to solve the problem of The prominent and powerful Reverend George Washington Carawan.  

A cold 1904 January in Mitchel County North Carolina, the body of a young man is found lying near the railroad tracks. Lying face first in or near a small creek, The young man shot three times in the head and five in the back.   The county Coroner was summed and an inquest held. In 1900’s North Carolina many times the initial investigation of a death or homicide was completed by a coroner's jury. They would make the initial determination of foul play. If so the case would be sent to law-enforcement and the court system.   The murder of 19 year old Mr. Shell from Tennessee with 124 dollars gold in just paid wages in his pocket, would turn into a shade of blue involving attempted jail breaks, planed lynchings and the Sheriff under cover of darkness removing the suspect from the county for safe keeping. In the mid 1960’s  Mary Little was a Bank secretary in Atlanta, Georgia, she disappeared from the parking lot of Lenox Square Mall shopping one night. Unusual evidence is uncovered in the investigation  including connections to the  Appalachian Mountains of Western North Carolina. A second missing young lady over a year latter from the same bank with similar connections to Mary Little, fails to show up for work one morning. Crime and punishment in the Appalachian Mountains.  On Oct. 2, 1905, A man was hung at Marshall NC the County seat of Madison County.  Most of us history nuts in the Western NC area are familiar with the Hanging of Peter Smith.   Growing up in Madison Co. I had heard the stories and have seen the photographs of Smith standing on the gallows in Marshall out side of the Jail in  1905.   The concussions over the years I was told was that Smith did not commit the crimes he had been accused of. A murder of a young girl then several years later a rape of another young girl.  I had been told many times that he had been framed for the assault.
