In its many constructions, Jail has, at times, been full of criminals, both State and federal, some of whom were men of means and Influence. Men who could afford outside help to make their escape. JESSE JAMES BAILEY- lawman extraordinaire who served as sheriff of two different North Carolina Countries in the 1920s.  Former Detective for Southern Railway, a celebrated humorist and storyteller, and a feared moonshine still wrecker. Bailey worked in several capacities for the railroad for 52 years until his retirement at age 70 in 1958. He took two leaves of absence of two years each in 1920 and 1928 when he was elected sheriff first of Madison and then Buncombe County, NC. The only lawman in the state to serve as sheriff in two counties. Bailey was born near Bailey's Bend on the French Broad River in Madison County. He was a farm boy until his telegrapher's job at Bailey Station in the Knoxville, Tenn., division of Southern Railway in 1906. Update on the September bonus episode of the Felon File Podcast. The Heath High School shooter's parole hearing on if he will be allowed to return to society and the public.  It will be Monday, September 26, before we know if Michael Carneal will be paroled or remain behind bars. The hearing decision was deferred until Sept. 26.   After serving 25 years of his life sentence, Carneal is now eligible for parole. Despite questioning Carneal for more than an hour,   the two parole board members in charge of his hearing could not reach a unanimous decision. What comes next for Carneal has the attention of not just McCracken County but the nation. He's one of the first convicted school shooters to be eligible for parole. He was  diagnosed with anxiety, depression, and severe paranoia. December 1, 1997, Michael Carneal wrapped a shotgun and a rifle in a blanket and took them to school, passing them off as an art project he was working on. He carried a loaded Ruger MK II .22-caliber pistol in his backpack. He rode to school with his sister, arriving; he inserted earplugs and took the gun out of his bag. Then, during a before-school prayer meeting, He fired ten rounds quickly at a  group of students. He got tired and pulled his vehicle over to get some sleep. Hauling freight is an old profession. The methods of doing it have evolved but its still a matter of moving goods from one place to another. Lester had no reason to think it would be a problem, he had been doing it for years.  Unfortunately Lester never woke up. He was shot once. With .32 caliber pistol. The bullet going straight into his brain. This was the first attack of the murder named the Turnpike Phantom. The crime in this case was the  murder of Philip Barton Key II, the son of Francis Scott Key, author of “The Star-Spangled Banner,” the national anthem of the United States. Sickles approached Key in DC’s Lafayette Square — a short distance from the White House –and shot him in the groin. “You villain, you have dishonored my house, and you must die!” Sickles reportedly said. A cold 1904 January in Mitchel County North Carolina, the body of a young man is found lying near the railroad tracks. Lying face first in or near a small creek, The young man shot three times in the head and five in the back.   The county Coroner was summed and an inquest held. In 1900’s North Carolina many times the initial investigation of a death or homicide was completed by a coroner's jury. They would make the initial determination of foul play. If so the case would be sent to law-enforcement and the court system.   The murder of 19 year old Mr. Shell from Tennessee with 124 dollars gold in just paid wages in his pocket, would turn into a shade of blue involving attempted jail breaks, planed lynchings and the Sheriff under cover of darkness removing the suspect from the county for safe keeping. Crime and punishment in the Appalachian Mountains.  On Oct. 2, 1905, A man was hung at Marshall NC the County seat of Madison County.  Most of us history nuts in the Western NC area are familiar with the Hanging of Peter Smith.   Growing up in Madison Co. I had heard the stories and have seen the photographs of Smith standing on the gallows in Marshall out side of the Jail in  1905.   The concussions over the years I was told was that Smith did not commit the crimes he had been accused of. A murder of a young girl then several years later a rape of another young girl.  I had been told many times that he had been framed for the assault.
