When to Use an NDA and when is it overkill

When to Use an NDA and when is it overkill

When do you need to use an NDA?  Well first off, an NDA is a non-disclosure agreement.  It means that anyone you speak with about your invention is legally bound to keep it to themselves.  You will need to have a template available to send to anyone you plan to work with, minus your attorney, up until your patent is in Patent Pending status.  If an attorney tells you that you need to worry about NDAs after your patent, then you should get a new attorney, one who understands the process.  Once your patent has issued, your invention is part of the public domain.  And that’s ok, because the patent is your protection.  If your attorney is extremely pushy about it, you should probably find out why he/she doesn’t trust the work they did... What to Do When You Can't File the Traditional Patent? With The Inventor Lady & Inventor of PINERITE - Andre Roy

What to Do When You Can't File the Traditional Patent? With The Inventor Lady & Inventor of PINERITE - Andre Roy

For this week's segment of Invent America, Michael King and co-host Rita Crompton discuss "What to Do When You Can't File the Traditional Patent?" with Andre Roy. Roy invented a way to process forest biomass and developed a special pine soap product, Pinerite.  Soon after his retirement Andre invented a new way to process forest biomass.  This included a method of processing needles and tree limbs using a new machine which he was granted a U.S. patent.  The primary product from this patented machine was a very high quality fertilizer that has important international promise.  This fertilizer has been tested and studied by the Colorado State University of Colorado with very positive results.  During 2012 and 2013 he was asked by CSU to take over the managing responsibilities of the Water and Soil laboratory.   While expanding the possibilities of his new machine, Andre decided to bring to market a special pine soap product he developed.  This product is called Pinerite.  From a modest beginning,  within the time frame of 3 and a half years he has grown the business to a national and now international level.  As you can see Andre is not good at retiring. https://pinerite.com https://www.facebook.com/profile.php?id=100063526871777 Rita Crompton, known as "The Inventor Lady," is an industry expert with decades of experience helping innovators develop their ideas into sellable products. The Best Parts of the National Hardware Show

The Best Parts of the National Hardware Show

While Inventor Lady, Rita Crompton, has been attending the National Hardware Show (NHS) for the past 15 years, the 2022 show was Kat Crompton’s first show. The large open floor plan that included rows upon rows of vendor booths was what she expected from a professional tradeshow. But where the NHS deviated from her expectations was in all the opportunities offered to showcase products besides just a booth. The NHS does a great job creating other areas that inventors can capitalize on to get more visibility for their products. Those areas include a Habitat location, the United Inventors Association stage and new product area, a large stage in the backyard area where inventors can give demonstrations or presentations. Invitation-only panels are routinely run where inventors can talk about their journeys to market and participate in question and answer sessions with the audience. Kat had the opportunity to work with several UIA representatives as a new product judge and sit on an advice panel for product pitches. NHS 2022 was also the first time she got to experience being a part of the Inventor Lady’s team and learn what a different opportunity it presents for the inventors attending to go as part of the team. In most cases, when an inventor goes as an individual, getting to participate in the previously mentioned other showcasing areas is hard because he/she is limited to keeping the booth manned. But when you go as part of the IL team, there are always people at the booth to have you back and represent you. That frees up more time to spend networking and participating in other areas of the show. If someone comes by that expresses interest in your product, someone from the IL team is there to offer information on your product, provide your contact info, scan a badge, or get their contact info. You don’t have to worry about missed opportunities for networking or interest. The Inventor Lady booth location has been upped in size and location quality with every year attended. You get to capitalize on a reputation years in the making. We’ve come a long way with our visibility and at the 2023 show we will be right up by the main entrance. Previous attendees have won the Retailer’s Choice Award as well as some others receiving honorable mentions. The IL booth itself is an award winning booth, having previously won the Most Interactive Booth Award. After attending last year, we had one inventor say he received 100,000 hits on his webpage following the show. Simply put, attending as a part of this group will expose you to greater visibility, opportunities for being invited to speak on stage or participate in panels, as well as things not associated with the show like radio interviews and TV interviews. Attending on your own means you will be at square one and faced with the dilemma of how to be in more than one place at a time. Attending with the Inventor Lady offers so much more. We are looking for more inventors to join us at the 2023 show who are in patent pending status and have a sexy proof of concept prototype. If that describes you, please contact us. We are currently working to get our inventors’ products listed on the NHS website so they can capitalize on all the pre-show publicity! Sign Up Now For The National Hardware Show

The National Hardware Show for 2023 is coming up really fast. It will be held 01/31/23-02/02/23 in Las Vegas. The really exciting thing about the 2023 show is that it won’t just be the National Hardware Show, it will also encompass the National Builders Show and the Kitchen and Bath Show. For those of you wondering why we make such a big deal out of attending a professional tradeshow, the reason is experience has taught me it’s the best bang for your buck when it comes to marketing a product. While attending a professional tradeshow does cost money, it’s a fraction of what you potentially end up paying for professional marketing campaigns to debut a product. There will be a cost, no matter how you end up marketing your idea. But it doesn’t have to cost tens of thousands of dollars to meet the right people and get the right feedback. So other than debuting your product, why else do we recommend a professional tradeshow? It’s a great way to get feedback on your product and determine interest. A professional tradeshow offers more coverage, more visibility and more opportunities to talk to interested parties in a few days than in a year of other marketing options. You get exposed to store owners, buyers and representatives from big box stores. You also get see what other products are in the same industry, get ideas for packaging, and get some price point guidelines. There is so much to learn and gain knowledge about in just a few days. That’s why we say this is the biggest bang for your buck. When you attend a tradeshow, one of the most common questions asked is about your suggested retail price. And if you have an answer, or at least a range, that’s important. For example, let’s say you invent a new type of or improved flashlight. You can go to somewhere like Target and find the flashlight aisle and have a pretty good idea of the range most flashlights fall into. There will of course be some low end items and some higher end, but you can at least garner a target range. The reason this suggested retail price is important is because it helps you figure out what kind of margin you have to work with making a profit. The multiple of five is the easiest way to explain this. Let’s say you decide that your flashlight needs to sell for $20 to be competitive. The store selling it puts the $20 price tag on but they are only willing to buy it from you for $10. That means that a distributor will be looking to sell it to them for $5. So you need to be able to make it, package it, and ship it for $4. After all that, you only have $1 left to cover any marketing you need to do and pay all the service providers who helped you in the process. For a lot of inventors, that’s extremely hard to do. Attending the professional trade show helps you iron out all those details before hand so you know what you’re getting yourself into budget-wise. Another perk of the professional tradeshow is that they do a lot of online advertising in the days leading up to and following a show. For a little more money on your part, you have the opportunity to piggyback off this advertising and get extra exposure for your product. Attendees to these shows vary but you have a much better chance of speaking directly with licensees and store owners at them. Don’t attend the basic consumer shows. You may sell a few of your product at them, but at the professional tradeshow you have the opportunity to sell dozens, or meet people interested in signing a contract to sell thousands. Professional tradeshows are not open to the public. You also don’t want to limit yourself to a regional show, think national so you get as much visibility as possible. You want to focus on tradeshows that are specific to your industry and they exist for every industry imaginable. I’ve gone with an inventor to the National Asphalt Show. It was very well attended by the right people and ended up being very productive for that inventor. We tend to focus on the National Ha

The Inventor’s Round Table

The Inventor’s Round Table

New admin named for the Inventor’s Round Table, an independent organization designed to create a safe and secure place for inventors to go and be able to ask any and all questions they may have pertaining to the process of getting a product to market. The admin will by Kat Crompton. The Inventor’s Round Table (IRT) got its start more than 15 years ago. The idea came from Inventor Lady, Rita Crompton, traveling with several older inventors to numerous other meetings in the Denver metro area, who all complained that none of those meetings did things like they “used to”. The solution was obvious, mostly, a new group needed to be started with the ideals that it would never be fee based and it would always have a “round table” feel to it, where questions and discussions could be held. Many groups bring speakers in on a regular basis, but not that many create an environment where inventors can spend the time asking their questions about their specific situation. Sometimes the best advice you can get is from another inventor in the trenches with you. At IRT meetings, service providers are allowed in by invitation only! And any that are allowed to participate have been thoroughly vetted. Most of them we have known and been working with for years. Oftentimes, these service providers give the best advice on what to avoid and what to be wary of when working with others in their fields of expertise. It was an engineer that taught us the value of the different phases of engineering and why each was so important. The initial prototype designed just to give a visualization to an idea (think legos, cardboard, pipe cleaners) is just as valuable as the proof of concept prototype and the manufacturing design. Another benefit of attending regular IRT meetings is that you have the opportunity to learn what steps you need to plan on spending a lot of money on, and which steps are a waste. Inventing does take funds, but you want to be very mindful of how you spend those funds. The IRT meetings are all about discussion. While the meetings originated in the Denver area and eventually started happening in Salt Lake City as well, we have now gone to a virtual platform in order to accommodate as many people as possible. We remind everyone at the start of the meetings that you should be mindful of discussing “too much”, you’ll want to protect your intellectual property after all, but so much can be asked without giving away too many details. Why Is Joining a Group so Important

Why Is Joining a Group so Important

Video Text- Why Is Joining a Group so Important I’ve been adding on a caveat to all my videos lately about the virtual meetings that are available for everyone to attend. You may be wondering why I take the time to mention this every video- Because there’s immense value in attending meetings that allow you to converse directly with other inventors. We recently launched the Rural America branch of the Inventor’s Round Table. Our group has been around for 12 years and is a gold seal approved group from the United Inventor’s Association. We started as an in person group in the Denver Metro area before growing to other Colorado locations and then a Salt Lake City, UT location. Then the pandemic hit and we got to learn the value of virtual meetings. One good thing I think we can all agree came from the pandemic is the optimization of the virtual meeting platforms. We use google meetups to still host the Colorado and Utah meetings virtually and occasionally in person, but have recently added a Rural America branch so we can offer a venue for people who aren’t close enough to those locations to attend. Sometimes the best information you can get is from the inventor next to you, whether in person, or on a video call. Meetings offer the opportunity to hash it out with others who have been where you are and learn from their mistakes and successes. What worked? What crashed and burned? Inventing is a costly endeavor and there are so many mistakes that can be made, especially early on. Think how much you could benefit from learning from the mistakes of others, potentially saving you dollars? We all learn from asking questions and the inventing process if very fluid in nature, what you learn from one step impacts how you make your next step. And sometimes it’s better to know certain things sooner rather than later when money is involved. Like why it’s a poor decision to file your patent pro se. While you legally can, it can lead to too narrow of parameters for your patent. I worked with a guy several years ago who filed an original patent but with too narrow parameters and worse yet, it didn’t even work! So when he fixed it and tried to file a new patent, his application was denied because it infringed on his original! Nothing but money lost that could potentially have been avoided if he had had the opportunity to talk to other inventors. Dialogue that occurs during a meeting between all who attend helps you learn more and maybe even answers questions you didn’t know you had. Something I’ve learned with experience is that if one person has a question, a lot of other people need that question answered as well. If you live in a large metropolitan area there may be other groups that have regular meetings, you don’t have to attend ours, just make a point to attend somewhere. But if you aren’t in a big city, just hate traffic and dealing with parking, or have small kids that make it hard to get out to things in the evenings, please take the time to look up when the next virtual meeting is occurring and attend. You might be surprised at what these have to offer and what potential mistakes they can help you avoid! Find out about upcoming meetings from the Inventor Lady website: www.inventorlady.com

I have always thought of ideas but this one is the only one that I believe was given to me by God. I was watching TV one morning thinking I was going to have to close my current business when I saw a clip of a policeman walking through the water to save this elderly couple and it hit. I went to my dining room table and drew up the design and logo. This was the first time I ever thought of a logo for one of my ideas. I then went to my computer looked up seatbelt cutters and saw they all looked like glorified envelope cutters. Then I literally stood in my living and said alright God if this is going to work I need some miracles and the very next day they started happening. Here we are over five years later and now it's fantastic and we even now have a first responder’s safety pack and rewards program for them." What/Who is an Inventor? The Inventor Lady with Derry Griffin

What/Who is an Inventor? The Inventor Lady with Derry Griffin

The Inventor Lady interviewing inventor Derry Griffin Bio: Derry Griffin, a successful contractor for more than 25 years, has hands on experience in all aspects of the construction business. Over the years he has realized that there are a lack of products that provide contractors’ support and organization during basic construction processes. Since necessity is the mother of invention, he has created and implemented many items that facilitate more efficient and effective working methods promoting solid, quality handiwork, which ultimately increases job profitability. His goal is to alleviate basic frustrations all contractors experience by sharing his knowledge and products.
