IP... Frequently: A Not-Very Intellectual Business PodcastMar 07, 2023

Ep. 186 - Anything But The Truth
Truth is overrated. Since people don’t really care for truth, the media helpfully curates the news to only show us what we want to see. Illegal immigration is down 90%, President Biden is so focused on his job that he, unfortunately, can’t participate in debates, and interviews with 2024 Presidential candidates are scrubbed to only show the good bits.

Ep. 185 - Drop the Anchors
It’s been a tumultuous month for news media personalities, with both CNN and FOX parting ways with their popular anchors. What will the future hold for how people get their news? Will the unemployed Don Lemon and Tucker Carlson start a new collaboration where they engage in entertaining debates from two different perspectives? Or, perhaps America will finally realize that the best source for news can be found right here, on IP…Frequently.

Ep. 184 - Dominated by Artificial Intelligence
It’s becoming more apparent that AI is gearing up to dominate humanity, and David and Brad are along for the ride. Also in this episode, supplementing research papers with falsified data, simulating the harsh environment of Mars in a 1,700 square foot Houston condo, and drinking Drano versus drinking Bud Light.

Ep. 182 - Indicted
A former U.S. President is in hot water, and we’re not talking about Bill Clinton. This week, David and Brad tackle Trump’s indictment, what it means for him, and what it portends for all the other politicians who have paid off women to sign NDAs (and there are a lot of them). Meanwhile, stories of more significance (like the U.S. Army missing recruitment goals by 50%) barely raise an eyebrow on the national stage.

Ep. 181 - A skewed view of reality
David and Brad tackle the AI chat phenomenon and discover its responses to political and social issues to be a bit one-sided. Could this be due to companies like Google feeding AI only what they believe to be true? In other news the TSA has once again made the skies safer by ruling that peanut butter is, in fact, a liquid…and therefore banned in quantities larger than 3.4 ounces.

And in other news, deep-fried cauliflower sandwiches might just be coming your way.

Ep. 175 - What else are we missing?
According to the White House press secretary, there’s no indication of recent extra terrestrial activity, but David and Brad don’t want to rule that out just yet. They go on to ask if an alien invasion is brewing, what impact will that have on Biden’s reelection? Tune in for all that, and a possible new pandemic, only on IP…Frequently.

Ep. 151 All this Paranoia on the Right

Ep. 24 – Patent Trivia, Blue Crab festival
Check in with Brad Sheafe, Chief Intellectual Property Officer (CIPO) and David Pridham, CEO of Dominion Harbor, respectively. Blue Crabs from Maryland; chewing on a fingernail.

Ep. 23 – Licensing the Iconic Kodak Portfolio: Monetization Insights and the Clamfest
Check in with Brad Sheafe, Chief Intellectual Property Officer (CIPO) and David Pridham, CEO of Dominion Harbor, respectively. The guys start off with a review of the local clam festival.
Iconic digital imaging patent portfolio from Kodak. Dominion Harbor acquired nearly 4,000 digital imaging patents from Intellectual Ventures early in 2017. It was acquired by Dominion Harbor’s wholly owned subsidiary, Monument Peak Ventures (MPV), is the current assignee to this vast and valuable portfolio.
MPV continues to prosecute the Kodak portfolio with new issues on an almost weekly basis.

Ep. 22 – Sovereign Entities, Maine State Fair & Lacrosse Fantasy Leagues
Check in with Brad Sheafe, Chief Intellectual Property Officer (CIPO) and David Pridham, CEO of Dominion Harbor, respectively as they weigh in on the latest IP protection strategy in assigning one’s patent rights to legally protected sovereign entities in a last ditch effort to protect one’s patent rights from the Patent Trial and Appeals Board (PTAB).
Specifically, they are directing their attention to the recent Allergan case where they have agreed to pay the St. Regis Mohawk upwards of $15M a year to maintain ownership of their Restasis drug patents in an effort to exclude their scrutiny of both the Federal court system and the PTAB simultaneously.
Panel stacking – assigning specific Judges to specific cases in an effort predict or affect a particular outcome. Worse, the USPTO has gone on congressional record admitting to as much with not a hint of remorse or collusion guilt.
PTAB – is not an Article III tribunal however it acts as one on ruling over private property issues e.g. Patents

Ep. 21 – More on PTAB, or Moron PTAB, You Decide
David Pridham and Brad Sheafe explore new revelations at the PTAB that continue to show the odds against the individual inventor remain stacked against them. They speculate about the outcome of Oil States before the Supreme Court (#SCOTUS) challenging the constitutionality of the non-Article III body and how it has chosen to operate. The good news is we have seen a trickle of Federal cases now overturn negative PTAB rulings – so there is hope.
The PTAB admitting on the record that it, in fact, stacked the judges to insure a favorable outcome for itself.
The judges of the PTAB recently named out of private practice are now sitting before former clients’ cases at the PTAB.
The PTAB’s cavalier interpretation of patent law and precedent.

Ep. 20 – Anniversary Episode with Special Marshall Phelps Interview
Your hosts, Brad Sheafe and David Pridham are thrilled and privileged to bring you an intimate and illuminating interview with the esteemed Marshall Phelps. Marshall in addition to being, truly, the father (or Godfather as the case may be) of the modern patent era, has graciously agreed to be a member of the Dominion Harbor Board of Advisors.
About Marshall Phelps
Marshall Phelps is one of the leading figures in the field of intellectual property management and performance. He has pioneered many of IP’s leading strategies and best practices, and generated unprecedented results as head of IP business and strategy for IBM in the 1990s and then Microsoft in the 2000s.
Marshall served as Vice President at IBM, and was responsible for overseeing standards, telecommunications policy, industry relations, licensing, intellectual property law and management of a worldwide intellectual property portfolio of more than 35,000 patents and 8,500 trademarks. He transformed a function that had previously been associated with overhead to a $2 Billion annual profit center. Prior to heading IP business, he served IBM as Director of Government Relations in Washington and as Vice President of Asia Pacific operations in Tokyo.
From 2002-2010 Marshall was Corporate Vice President and Deputy General Counsel for Intellectual Property and Licensing, Microsoft Corporation. At Microsoft, his duties entailed worldwide management of the company’s intellectual property portfolio, patent prosecution, licensing, standards and business development. He facilitated Microsoft’s emergence as one of the world’s largest and most successful IP-related businesses with over 60,000 patents and applications, extensive copyright holdings and numerous trademarks.
In 2006, Marshall was elected to the initial class of the Intellectual Property Hall of Fame. In 2001 he was founding partner with Nathan Myhrvold of Intellectual Ventures, the largest acquirer of patents worldwide. His book, “Burning the Ships: Intellectual Property and the Transformation of Microsoft,” was published in 2009 to much acclaim.
Marshall has taught IP strategy at business, law or engineering schools at Duke, Cornell, UNC, Berkeley and in Japan. His latest academic foray will be teaching at USC this Fall. He also joined the first Dominion Harbor Board of Advisors in 2017.
He holds a B.A. from Muskingum College, an M.S. from Stanford Graduate School of Business, and a J.D. from Cornell University Law School. Marshal serves as a director and advisor to multiple companies in and around tech and intellectual property.

Ep. 19 – Take Me To Your PTO Leader, Andrei Iancu
Your hosts, Brad Sheafe and David Pridham discuss the recent appointment of Andrei Iancu to be the new Director of US Patent Office, or could it be a more sinister Patent Czar? Listen in to learn why.
They speculate on his new patent policies and whether he is in a position to begin to reverse so much of the damage to the US patent system inflicted upon us under Michele Lee and the Obama-era administration, starring your favorite tech company to hate, Google, Alphabet or whatever they call themselves these days aside from menacing threat to the individual inventor.
From Bio Page of Irell & Manella LLP
Andrei Iancu is the Managing Partner of Irell & Manella LLP. Mr. Iancu also practices full time as a member of the litigation and intellectual property practice groups.
Mr. Iancu’s practice focuses on intellectual property litigation. He has also been involved in all other aspects of the intellectual property practice, including prosecution, due diligence and licensing. Mr. Iancu is registered to practice in the U.S. Patent & Trademark Office. He has represented clients across the technology spectrum, including those associated with medical devices, genetic testing, therapeutics, the Internet, telephony, TV broadcasting, video game systems and computer peripherals.
In addition to his practice, Mr. Iancu co-teaches patent law at the UCLA School of Law.
In 2016, the Los Angeles Business Journal named Mr. Iancu Lawyer of the Year for firms with 75-125 attorneys. In 2017, he was selected as one of BTI’s Client Service All-Stars, a list of attorneys singled out for exemplary client service by corporate counsel at large organizations. In 2013, California Lawyer magazine named Mr. Iancu an Attorney of the Year in the area of intellectual property. The CLAY award, as it is commonly known, is given annually to California attorneys whose achievements had a significant impact on the law. Mr. Iancu was recognized for the large settlements he secured in 2012 for TiVo. Overall, judgments and settlements for TiVo resulting from patent cases against EchoStar, AT&T, Verizon, Microsoft, Motorola and Cisco resulted in total payments to TiVo of over $1.6 billion.

Ep. 18 – Not Dr. Roy on the Attack and Phi Delta Phu
Tossing offhanded rhetoric about a company’s intentions or motivations without any facts or insights is not proper and it leads to dangerous precedence – primarily with the uninitiated in the IP industry. Readers will just take these labels at face value and render an ill-informed opinion.
Dominion Harbor has helps dozens of F500/G2000 companies and equally important individual inventors receive fair value for their inventions. Our advocacy is FOR patent and FOR inventors both directly against infringers, but equally important in the halls of congress and the courtroom.
We invite anyone to see how much effort, technical and legal expertise our teams put into determining if we should move forward on an opportunity. Further, we wish we could share all the inbound inquiries from small inventors pleading for us to help them take on much larger firms whom they believe are taking their ideas; the rules are stacked against them and they require experts to help.
This is the Techrights story that got the guys to come to know Roy Schestowitz – and his, nothing short of wild ,conspiracy theories.
“Earlier today Benjamin Henrion pointed out that David Pridham, “CEO of the patent advisory [sic] Dominion Harbor Group,” now has a blog (even an attack on Google) over at Forbes. Dominion Harbor Group is a patent troll, not “patent advisory” or whatever euphemism they may choose. It’s also connected to Intellectual Ventures, the world’s largest patent troll. So what we have here are anti-Google articles from a man who is connected to Microsoft’s patent troll. Ain’t that just too shallow? Is he going to sue Google next? He recently got a big load of patents from Intellectual Ventures [1, 2]. Such patents can never be used against Microsoft because Intellectual Ventures is deep in the pockets of Microsoft and Bill Gates (at a personal capacity, too)…”

Ep. 17 – Google Paying Academics & Being Blocked On Twitter
From our recent IPWire blog post from Patrick Anderson on Unified Patents’ PTAB win record.
As part of our ongoing series to factually expose the patent opposition’s effort of “de-propertization” of patents, I further breakdown Unified Patents as more the devil of patents than Saint Thomas More. Last month, I posted a detailed breakdown of Inter Partes Review statistics relating to petitions filed by self-proclaimed ‘Anti-Troll’ Unified Patents. While I highly recommend you read that post, a few of the highlights for convenience:
A paltry 34% institution rate (compared to about 71% for the PTAB overall)
An Institution:Denial ratio less than one
A substantially higher settlement rate than average
Google Buys Academic to Support Their Anti-Patent Agenda
The Wall Street Journal article exposing Google for paying for academic research that “independently” supports their anti-patent agenda.
By Brody Mullins and Jack Nicas | Updated July 14, 2017 9:14 a.m. ET
“Google operates a little-known program to harness the brain power of university researchers to help sway opinion and public policy, cultivating financial relationships with professors at campuses from Harvard University to the University of California, Berkeley.”

Ep. 16 – Professor Adam Mossoff George Mason Univ / co-founder CPIP
Discussion centers on the uncertainty in the United States patent system and the the “de-propertization” of intellectual property and those organizations that are driving a negative false narrative that patent trolls are ruining the system and the US needs to legislate a new solution.
Adam Mossoff
Adam Mossoff is Professor of Law at Antonin Scalia Law School, George Mason University. He is a founder of the Center for the Protection of Intellectual Property, and is now a Director of Academic Programs and a Senior Scholar. He teaches a wide range of courses at the law school, including property, patent law, trade secrets, trademark law, remedies, and internet law. He has published extensively on the theory and history of how patents and other intellectual property rights are fundamental property rights that should be secured to their owners and legally protected as commercial assets in the marketplace. He has testified before the Senate and the House on patent legislation, and he has spoken at numerous congressional staff briefings and academic conferences, as well as at the PTO, the FTC, the DOJ, the National Academy of Sciences, and the Smithsonian Museum of American History. His writings on patent law and policy have also appeared in the New York Times, Forbes, Investors Business Daily, The Hill, Politico, and in other media outlets. He is a member of the Public Policy Committee of the Licensing Executives Society, an appointed member of the Amicus Committee of the American Intellectual Property Law Association, and a member of the Academic Advisory Committee of the Copyright Alliance. He has served as past Chair and Vice-Chair of the Intellectual Property Committee of the IEEE-USA.

Ep. 15 – Adjustacam LLC v Newegg Attorneys’ Fees or Somali Pirates
Today, Brad and David discuss the recent Adjustacam (subsidiary of Acacia Research) v Newegg case where Newegg was awarded legal fees. The also provide some depth on the Somali Pirate problem.
Opinion Summary: AdjustaCam, LLC v. Newegg, Inc., __ F.3d __, 2017 WL 2854387 (Fed. Cir. July 5, 2017)(Reyna, J.), the Federal Circuit remanded a patent infringement case to the Texas trial court to grant an award of attorney fees against the patentee in favor of the accused.
From the Opinion: “The district court abused its discretion failing to follow our mandate to evaluate the totality of the circumstances under Octane in the first instance. Moreover, [patentee] AdjustaCam filed a weak infringement case against [accused infringer] Newegg that became objectively baseless after the district court’s Markman order. The district court’s determination that AdjustaCam could reasonably argue infringement post-Markman is based on clearly erroneous fact-findings. AdjustaCam also unreasonably litigated the case by repeatedly serving expert reports and declarations at the last minute. The pattern of low and erratic settlements, though not determinative, reinforces a conclusion of unreasonableness. The district court’s conclusion that AdjustaCam reasonably litigated this case was clearly erroneous. Based on the totality of these case-specific circumstances, we hold that the district court abused its discretion in denying Newegg’s motion for fees.”
