It was acquired by Dominion Harbor’s wholly owned subsidiary, Monument Peak Ventures (MPV), is the current assignee to this vast and valuable portfolio.


MPV continues to prosecute the Kodak portfolio with new issues on an almost weekly basis.

Specifically, they are directing their attention to the recent Allergan case where they have agreed to pay the St. Regis Mohawk upwards of $15M a year to maintain ownership of their Restasis drug patents in an effort to exclude their scrutiny of both the Federal court system and the PTAB simultaneously.

About Marshall Phelps

Marshall Phelps is one of the leading figures in the field of intellectual property management and performance. He has pioneered many of IP’s leading strategies and best practices, and generated unprecedented results as head of IP business and strategy for IBM in the 1990s and then Microsoft in the 2000s.


Marshall served as Vice President at IBM, and was responsible for overseeing standards, telecommunications policy, industry relations, licensing, intellectual property law and management of a worldwide intellectual property portfolio of more than 35,000 patents and 8,500 trademarks. He transformed a function that had previously been associated with overhead to a $2 Billion annual profit center. Prior to heading IP business, he served IBM as Director of Government Relations in Washington and as Vice President of Asia Pacific operations in Tokyo.


From 2002-2010 Marshall was Corporate Vice President and Deputy General Counsel for Intellectual Property and Licensing, Microsoft Corporation. At Microsoft, his duties entailed worldwide management of the company’s intellectual property portfolio, patent prosecution, licensing, standards and business development. He facilitated Microsoft’s emergence as one of the world’s largest and most successful IP-related businesses with over 60,000 patents and applications, extensive copyright holdings and numerous trademarks.


In 2006, Marshall was elected to the initial class of the Intellectual Property Hall of Fame. In 2001 he was founding partner with Nathan Myhrvold of Intellectual Ventures, the largest acquirer of patents worldwide. His book, “Burning the Ships: Intellectual Property and the Transformation of Microsoft,” was published in 2009 to much acclaim.


Marshall has taught IP strategy at business, law or engineering schools at Duke, Cornell, UNC, Berkeley and in Japan. His latest academic foray will be teaching at USC this Fall. He also joined the first Dominion Harbor Board of Advisors in 2017.


He holds a B.A. from Muskingum College, an M.S. from Stanford Graduate School of Business, and a J.D. from Cornell University Law School. Marshal serves as a director and advisor to multiple companies in and around tech and intellectual property.

As part of our ongoing series to factually expose the patent opposition’s effort of “de-propertization” of patents, I further breakdown Unified Patents as more the devil of patents than Saint Thomas More.  Last month, I posted a detailed breakdown of Inter Partes Review statistics relating to petitions filed by self-proclaimed ‘Anti-Troll’ Unified Patents. While I highly recommend you read that post, a few of the highlights for convenience:


A paltry 34% institution rate (compared to about 71% for the PTAB overall)

An Institution:Denial ratio less than one

A substantially higher settlement rate than average

Adam Mossoff

Adam Mossoff is Professor of Law at Antonin Scalia Law School, George Mason University. He is a founder of the Center for the Protection of Intellectual Property, and is now a Director of Academic Programs and a Senior Scholar. He teaches a wide range of courses at the law school, including property, patent law, trade secrets, trademark law, remedies, and internet law. He has published extensively on the theory and history of how patents and other intellectual property rights are fundamental property rights that should be secured to their owners and legally protected as commercial assets in the marketplace. He has testified before the Senate and the House on patent legislation, and he has spoken at numerous congressional staff briefings and academic conferences, as well as at the PTO, the FTC, the DOJ, the National Academy of Sciences, and the Smithsonian Museum of American History. His writings on patent law and policy have also appeared in the New York Times, Forbes, Investors Business Daily, The Hill, Politico, and in other media outlets. He is a member of the Public Policy Committee of the Licensing Executives Society, an appointed member of the Amicus Committee of the American Intellectual Property Law Association, and a member of the Academic Advisory Committee of the Copyright Alliance. He has served as past Chair and Vice-Chair of the Intellectual Property Committee of the IEEE-USA.

Opinion Summary: AdjustaCam, LLC v. Newegg, Inc., __ F.3d __, 2017 WL 2854387 (Fed. Cir. July 5, 2017)(Reyna, J.), the Federal Circuit remanded a patent infringement case to the Texas trial court to grant an award of attorney fees against the patentee in favor of the accused.

From the Opinion: “The district court abused its discretion failing to follow our mandate to evaluate the totality of the circumstances under Octane in the first instance. Moreover, [patentee] AdjustaCam filed a weak infringement case against [accused infringer] Newegg that became objectively baseless after the district court’s Markman order. The district court’s determination that AdjustaCam could reasonably argue infringement post-Markman is based on clearly erroneous fact-findings. AdjustaCam also unreasonably litigated the case by repeatedly serving expert reports and declarations at the last minute. The pattern of low and erratic settlements, though not determinative, reinforces a conclusion of unreasonableness. The district court’s conclusion that AdjustaCam reasonably litigated this case was clearly erroneous. Based on the totality of these case-specific circumstances, we hold that the district court abused its discretion in denying Newegg’s motion for fees.”
