Samuel D. Green on Reason for Life and sharing the pro-life message through Christian communities

Samuel D. Green on Reason for Life and sharing the pro-life message through Christian communities

We speak today with Samuel D. Green, President & General Counsel of Reason for Life. Reason for Life encourages, equips, and educates Christian leaders who are hesitant to address abortion, helping them see that sharing the truth about this subject is both essential and loving.

Before founding Reason for Life, Samuel spent five years at Alliance Defending Freedom (ADF), where he engaged in litigation to defend the sanctity of life, freedom of speech, and religious liberty. Samuel has also worked as a litigation associate at a large law firm (Jenner & Block), as a member of a presidential campaign’s legal team, and as a law clerk to the Honorable Raymond W. Gruender of the U.S. Court of Appeals for the Eighth Circuit.

Samuel finished first in his class at Pepperdine University School of Law, where he earned a Juris Doctor degree in 2011. He also studied political science at the University of California, Los Angeles (UCLA), where he graduated, summa cum laude, with a Bachelor of Arts degree in 2008.

Samuel has provided legislative testimony, preached sermons about the sanctity of life, and given presentations across the country to various groups or their chapters (including Students for Life of America, 40 Days for Life, Summit Ministries, Teen Pact Leadership Schools, the Federalist Society, and the St. Thomas More Society). Samuel has also participated in media interviews and published articles with various outlets, including Newsweek, The Seattle Times, The Hill, Washington Examiner, The Federalist, and The Daily Signal. Additionally, Samuel authored a legal brief in the historic Supreme Court case that overturned Roe v. Wade.

Mayra Rodriguez, ex-Planned Parenthood director and whistleblower, on becoming unapologetically pro-life

Mayra Rodriguez, ex-Planned Parenthood director and whistleblower, on becoming unapologetically pro-life

The reversal of Roe v. Wade is changing the landscape for the human right to life across America. We know of so many states where the human right to life is being affirming, enshrined, and upheld. Unfortunately, however, many states and cities will continue to perpetuate abortion. Planned Parenthood and abortion businesses are multi-billion dollar Goliaths whose power remains intact, even though abortion is no longer recognized, as it unfortunately was for too long, as a right.

Today we are excited to speak with Mayra Rodriguez, former director of three Planned Parenthood facilities. Mayra left the abortion industry, and in 2019 Mayra prevailed in a $3 million lawsuit for wrongful termination against Planned Parenthood. Mayra sees her life has having been transformed by the mercy of God, and now sees it as her life mission to expose Planned Parenthood, abortion businesses, and to make abortion unthinkable.

Mayra is a speaker, wife, mother, and courageous pro-life leader. Mayra joins Tom Shakely and Elli Jochims on Life, Liberty, and Law.

Catherine Glenn Foster and Josh Craddock on the twilight of Roe and the dawning of U.S. Constitutional protections for the human right to life

Catherine Glenn Foster and Josh Craddock on the twilight of Roe and the dawning of U.S. Constitutional protections for the human right to life

The overturning of Roe v. Wade continues to send shockwaves through not only the United States of America, but also our allies internationally. For the first time, many are discovering that the overturning of Roe and the ending of our extreme abortion jurisprudence actually doesn’t change that much on the ground in states that will continue to be pro-abortion, and that in states that are embracing pro-life law and policy, most American pro-life law mirrors European-style protections—for instance, Mississippi’s law which the U.S. Supreme Court just upheld protects life at 15 weeks of a preborn child’s life. This means that Mississippi’s abortion laws are, actually, more liberal than the abortion laws on the books in nations like Italy, France, or most other European allies.

If Roe’s reversal means that even pro-life states will generally mimic European-style laws, where killing is still permissible throughout the first months of a child’s life, does this represent a true pro-life victory? No. There’s more to be done—Americans United for Life will continue to call upon the Executive, Legisltive, and Judicial branches to clarify that abortion is fundamentally incompatible with constitutional justice. We will continue to call upon the U.S. Supreme Court to clarify that natural human rights precede the letter of any constitution, and that our first and most fundamental of all human rights—the human right to life—means that unborn children are entitled to the equal protection of the laws.

Today we feature an important conversation hosted by our friends at Live Action on June 24th, 2022, the day of the release of the Supreme Court’s Dobbs decision and its reversal of Roe v. Wade. Catherine Glenn Foster, President & CEO of Americans United for Life speaks on what true constitutional justice looks like, and how the pro-life movement can cast a vision of a truly brighter future for all. Catherine is joined by Josh Craddock, Affiliated Scholar at the James Wilson Institute and Noah Brandt, Director of Government Affairs at Live Action.

Catherine Glenn Foster, President & CEO of Americans United for Life joins Steven H. Aden, Chief Legal Officer & General Counsel and Tom Shakely on AUL's "Life, Liberty, and Law" to celebrate the U.S. Supreme Court's reversal of Roe v. Wade and the future of pro-life advocacy.

“Today, the U.S. Supreme Court has correctly and courageously reversed Roe v. Wade and restored a future full of hope for Americans of all ages, backgrounds, and beliefs. No more will the national fiction of abortion violence be perpetuated as if it could be a constitutional right. After nearly fifty years and the loss of more than sixty-two million American lives, Americans can once more choose to protect human life through their elected lawmakers,” said Catherine Glenn Foster, President & CEO of Americans United for Life.

“Today is a promise of hope for all members in the human family, but especially for women and those millions who will now be protected from prenatal violence,” said Catherine Glenn Foster. “The work of Americans United for Life and the Pro-Life Movement has truly just begun. We invite all Americans to walk alongside us in the days, months, and years to come to enshrine pro-life laws in every state to uphold the human right to life, and to work toward the urgent and still necessary goal of abolishing abortion in American culture. We must clarify, as a constitutional matter as much as a matter of fundamental justice, that abortion shall not exist in the United States of America. And we must simultaneously strengthen American programs ensuring every person, born and not yet born, is equipped and empowered to thrive.”

Dr. Catherine Ruth Pakaluk on American birth rates, pro-family policies, and paths to glory in everyday life

Dr. Catherine Ruth Pakaluk on American birth rates, pro-family policies, and paths to glory in everyday life

When the COVID-19 pandemic hit in early 2020 and Americans entered into what authorities assured us would be "two weeks to slow the spread," many predicted a baby boom would be the natural result of this time of closeness in quarantine. Yet there’s been no baby boom. And in fact, it looks like family formation and birth rates may, in fact, be continuing to decline as a result of the pandemic and the economic fallout of more than two years of ad hoc state and fiscal policy decisions.

As human persons, we’re make for relationship. We’re made for each other. We’re made for family and for community. We’re made for love. These insights are at the heart of Americans United for Life and our mission to advance the human right to life in culture, law, and policy.

So what do these challenging trends in birth rates, family formation, and economic portend for American life—and a possible poe-Roe cultural and political environment?

We’re thrilled to speak today with Dr. Catherine Ruth Pakaluk, Associate Professor at The Catholic University of America. Dr. Pakaluk joined the faculty at the Busch School in the summer of 2016, and is the founder of the Social Research academic area, where she is an Associate Professor of Social Research and Economic Thought. Formerly, she was Assistant Professor and Chair of the Economics Department at Ave Maria University. Her primary areas of research include economics of education and religion, family studies and demography, Catholic social thought and political economy.

The U.S. Senate Judiciary Committee has wrapped up its weeklong hearings with Judge Ketanji Brown Jackson, who appears set to succeed U.S. Supreme Court Justice Stephen Breyer. Judge Jackson describes Roe v. Wade as settled law and would be a reliable vote for abortion on the high court, yet describes herself as an originalist. Steven H. Aden, Chief Legal Officer at Americans United for Life joins Katie Glenn, Government Affairs Counsel, to speak about Judge Jackson's surprising claim and reflect on what Justice Jackson might for the future of the Supreme Court and for abortion jurisprudence.

Clarke Forsythe on Roe v. Wade's anniversary, the Supreme Court's need for courage and humility, and decades judicial and scholarly criticism

"There is a wide-spread myth that Roe v. Wade is settled and entitled to respect as judicial precedent. The purveyors of this myth must ignore the U.S. Supreme Court’s decisions going back to the earliest days of the Court—which point to judicial criticism and legal-scholarly criticism as keeping prior decisions unsettled.

"Most importantly, they purveyors of the myth that Roe is settled and entitled to respect as judicial precedent must ignore four decades of detailed, comprehensive, and specific judicial and scholarly criticism of Roe itself. It is precisely because Roe has never been settled that it is entitled to no respect as precedent. In fact, because Roe is radically unsettled, long-standing principles of precedent dictate that it must be reconsidered."

These words are from Clarke Forsythe, Senior Counsel at Americans United for Life and author of AUL's just-released, “A Survey of Judicial and Scholarly Criticism of Roe v. Wade Since 1973: Legal Criticism and Unsettled Precedent”. We speak with Clarke today about his new and important survey of judicial and scholarly criticism of Roe and what lessons that advocates and lawmakers can take away from the past half century of popular, constitutional criticism of Roe and abortion culture.

Aubrey Schlackman on Blue Haven Ranch, the virtue of hospitality, and offering what you have for mothers considering abortion

Aubrey Schlackman on Blue Haven Ranch, the virtue of hospitality, and offering what you have for mothers considering abortion

Planned Parenthood and other abortion businesses have been on the decline in America for years now. It's common knowledge amongst Americans within the pro-life community that life-affirming pregnancy resource centers today outnumber abortion businesses like Planned Parenthood by more than three to one. If you were to scatter all those pro-life pregnancy resource centers evenly across the country, every county in America would have at least one pro-life pregnancy resource center.

What makes America's experience since Roe all the more remarkable is that there is no pro-life equivalent of Planned Parenthood—there's no mega-NGO or national nonprofit organization organizing the alternatives-to-abortion movement. It's everyday women and men, the hometown heroes who we sometimes imagine only still exist in our cultural imagination, who are building the alternatives that charity, justice, and simple decency calls for.

Aubrey Schlackman, Founder & Executive Director of Blue Haven Ranch, is one of these American heroes. We speak with Aubrey today to learn what drew her, and her husband Bryan, to the issue of abortion alternatives, what sets Blue Haven Ranch apart, and how supportive communities can come together to promote resilient alternatives for the future.

Abby Balmert, AUL Law & Policy Fellow, reflects on this year’s life advances and the privilege of playing a part

It has been a monumental year in the pro-life movement and Americans United for Life has flourished. Our team has adjusted to pandemic challenges and capitalized on crucial opportunities to advance the human right to life.

In 2021, this movement proved to be resilient, creative, and strong. In the summer of 2021, AUL hosted legal fellows and undergraduate interns in its Washington, DC office. These fellows spent countless hours researching, writing, and preparing for Dobbs v. Jackson Women’s Health and other crucial decisions like allowing the Texas Heartbeat Act to remain in effect.

Today we are joined by Abby Balmert, an AUL Law & Policy Fellow, who played a huge role in AUL’s strong presence this year.

Americans United for Life works every day to defend the human right to life in culture, law, and policy, and today we get to see the fruit of our team and supporters’ passionate, justified, righteous efforts. Dobbs vs. Jackson Women’s Health is a case that has reached the Supreme Court because America is a place where all life should be embraced. For too long, the legal precedents of Roe and Casey have had a costly hold on American law, misrepresenting the beliefs of the majority of Americans and distorting our very own Constitution. This week, we get to witness history.

Lyman Stone on missing abortion data, America’s falling fertility, & incentives for family formation

Lyman Stone on missing abortion data, America’s falling fertility, & incentives for family formation

There are stark social consequences for America’s declining fertility. What can we do to reverse the trends we’re seeing? Politicians on both sides of the aisle propose incentives and resources for family formation, it is difficult to know which options would be successful. Good ideas for policy change begin with good data, and through commitment and cooperation we can move in a pro-family, pro-life direction.

Good data, however, is something that is unheard of when it comes to abortion. The abortion industry wants to hide the stories of mothers who have had traumatizing experiences with chemical or surgical abortion, and they have manipulated the government to rollback requirements on reporting. Today we are joined by an expert in data analysis to help us sift through ideas for strengthening the American family.

Lyman Stone is currently an adjunct fellow at the American Enterprise Institute, a Research Fellow at the Institute for Family Studies, and a former International Economist at the US Department of Agriculture, where he forecasts cotton market conditions. His work has been covered in the The New York Times, The Washington Post, The Wall Street Journal, and numerous local outlets. Erica Bachiochi on whole-life women’s rights, reliance interest in Dobbs, and common good thinking

With Dobbs vs. Jackson Women’s Health on the horizon, a host of voices have spoken out about the Supreme Court’s opportunity to rediscovery human right to life in its fullness in the United States Constitution. Fifty years ago, children in the womb were legally marginalized by a majority vote of 7 men on the U.S. Supreme Court who deemed those not yet born as merely “potential life.” Our culture has vastly changed in these past five decades—whether the Court has changed along with it is the question that the outcome in Dobbs will answer. Erika is advocating on many fronts for the human person and for the human family. Erika is a wife, mother of seven, fellow with the Ethics & Public Policy Center, director of the Wollstonecraft Project at the Abigail Adams Institute, and a visiting scholar at Harvard Law School. Erika is the author of The Rights of Women: Reclaiming a Lost Vision, in which she offers an original look at the development of feminism in the United States, advancing a vision of rights that rests upon our responsibilities to others. Erika, along with 239 other pro-life feminist scholars and professionals, has made her voice heard in the upcoming Supreme Court case. Their message? Roe and its progeny Casey may have foisted abortion upon Americans, but no woman relies on abortion for success in this society. We speak with Erika today on her book, on Dobbs v. Jackson Women’s Health, and on reclaiming common good thinking. https://aul.org/ Wollstonecraft Project: https://www.abigailadamsinstitute.org/aai-wollstonecraft-project Twitter: @erikabachiochi

Dr. Michael J. New on Marist's misleading abortion poll, identifying red flags in media, and 40 Days for Life

Is it foolish to assume we can trust research institutes who conduct public opinion polls? How do we know what is true? Why are pro-lifers so often mischaracterized? This season on Life, Liberty, and Law, we are tearing down lies that are being projected to Americans from news outlets, social media, and even from the floor of Congress about the value of life. One of those abominable messages we keep hearing is this: an America where abortion is unlimited is actually what most Americans want. We want to equip you for conversations about life. When each of us share our concern for the most vulnerable in our society with our friends, coworkers, and neighbors, hearts are changed. Today we have brought in one of the best experts to give us tools on how to trudge wisely through the media’s depiction of abortion policies and culture. Dr. Michael New is a Research Associate of Political Science and Social Research at The Catholic University of America, as well as an Associate Scholar at the Charlotte Lozier Institute.

"Life, Liberty, and Law" recently celebrated its second birthday—that's 24 months of conversations on how we can all work together to protect the human right to life in culture, law and policy.

We hope that Americans United for Life will continue to have these vital conversations for many years to come. Tom Shakely and Noah Brandt have hosted the show consistently, but today marks the final episode with Noah Brandt. After three consequential years, Noah is bidding farewell to Americans United for Life to continue his work on behalf of the human right to life in a new way.

Katie Glenn on the bravery of 228 members of the U.S. Congress calling on the Supreme Court to overturn Roe

Katie Glenn on the bravery of 228 members of the U.S. Congress calling on the Supreme Court to overturn Roe

Courage always begins in the heart, and although we don’t think of it this way nearly often enough, the virtue of courage (or bravery, fortitude, whatever you want to call it) is the foundation for every good and true act of politics and action of politicians. We see the importance of courage powerfully in Mississippi’s recent brief in defense of their state’s common sense 15-week pro-life protection law.

The Court will consider Dobbs v. Jackson Women’s Health Organization this fall and will likely reveal its ruling in June 2022. Americans United for Life is filing two briefs in this critical Supreme Court case, meant to guide the thinking of the justices on the path to not only upholding Mississippi’s common sense pro-life law, but also reversing Roe v. Wade and ending the violence of abortion across the states.

We must overcome cynicism in our politics if we want to build a better America, and that starts by recovering the virtue of courage in our imaginations as much as in our lives. We speak with Katie Glenn, GA Counsel at Americans United for Life, about Mississippi’s powerful arguments, what we’re arguing at Americans United for Life, and why there will be a fundamental reckoning if the Court does not protect life in this case.

Ernest Hemingway's 'Hills Like White Elephants' and abortion's violent and coercive nature in every time and place

Ernest Hemingway's 'Hills Like White Elephants' and abortion's violent and coercive nature in every time and place

In a way that only he can, Ernest Hemingway uses a literary device known as the Iceberg Theory to tell stories that lead readers to personal, emotional conclusions. In the short story "Hills Like White Elephants," Hemingway alludes to abortion without ever saying the word or even mentioning a baby. In this story, you’ll hear a man and woman talking over beer and liquor at a bar in Spain while they wait for a train. The emotional space between them is tense. Another character is present—a character whose life is on the line.

Today's episode is a little different than Life, Liberty, and Law's typical programing—it is a reading of Hemingway's "Hills Like White Elephants," sharing this timeless and timely short story and the lessons it imparts.

Abby Balmert on the human right to life in the law, Casa Teresa, and working with women in need to create a culture of life

Abortion is erroneous. And the reality is that women are often in terrible situations and abusive relationships when they face pressure to choose abortion. To capitalize on vulnerable circumstances, abortion activists ignore the connection and love that exists between babies and their mothers, declaring abortion is the only choice. At Americans United for Life, we affirm the dignity and incredible capabilities of mothers.

Each summer, Americans United for Life hosts legal fellows and undergraduate interns from around the country, all of whom have unique stories about how they came to join the pro-life movement. Today Abby Balmert, an Americans United for Life Legal Fellow, joins "Life, Liberty, and Law" to share her experience in the pro-life movement. Abby is pursuing her J.D. at Georgetown Law after four years as a policy advisor on Capitol Hill involved with the Pro-Life Caucus. Abby speaks about her unique experiences, including her work with Casa Teresa in Orange County, California, which exists “to provide pregnant women in crisis a loving home to begin their healing journey and to break cycles, transform women and help families thrive through effective, caring residential programs.” We celebrate the movement to affirm and equip women throughout motherhood.

Hadley Arkes on human rights, natural law and moral reasoning, and ‘recovering the things we used to know’

“Judges have delivered themselves into our hands—if we have the political wit to spring the trap. On the other hand, if we don't act, if we acquiesce in this, then we may be sleepwalking. We may be merely going through the motions when we vote again later this year on partial-birth abortion. It may be unavailing. It may become a gesture without consequence.”

Those are the words of Professor Hadley Arkes, pro-life legal maverick and friend of AUL’s “Life, Liberty, and Law”. He delivered those words at an Americans United for Life legislators conference in 1998, prior to the ultimately successful effort to forbid the horrendous practice of partial birth abortion.

Today we delve back into the Americans United for Life archives to listen to Professor Arkes’s full address, which continues to provide insight into our efforts today in courts and legislatures to protect women and children.

Let’s journey back to 1998, where Americans United for Life Senior Counsel Clarke Forsythe introduces Hadley Arkes.

William L. Saunders on human rights, 'Unborn Human Life and Fundamental Rights,' and the future of American law on life issues

William L. Saunders on human rights, 'Unborn Human Life and Fundamental Rights,' and the future of American law on life issues

We’re living through a time when, despite all our pretending in culture, in media, in law, it increasingly seems as it “might makes right”. As Americans, we’ve got a Constitution that we’re proud of—but on so many of the key issues, our Constitution and its guarantees and protections seem to evaporate. When our Constitution is silent, Supreme Court justices spring into action to creatively furnish cultural mores or supply new rights that they discovered in “emanations” from the written text. Most Americans understand this to be what it is: raw judicial power, rule by conjecture and innuendo. What Congress won’t do, and what Americans won’t vote for, judges can simply impose.

This plays out nowhere more clearly than with the human right to life. We have a Constitutional right to life. And yet: if someone wants to void that right we simply call the situation “complex” and that right vanishes in the form of abortion, euthanasia, suicide by physician, etc. We’ve got to recover a sense in America of what’s true, what’s fundamental, what’s right.

Bill Saunders, international human rights scholar who has devoted his life to recovering first principles, joins Tom Shakely and Noah Brandt on "Life, Liberty, and Law." Bill Saunders is a Law Fellow with the Institute for Human Ecology at The Catholic University of America, where he is also Professor and Director of the Program in Human Rights in the School of Arts & Sciences and Co-Director of the Center for Religious Liberty at the Columbus School of Law. Bill also serves as Chair of the Religious Liberties Practice Group of the Federalist Society. Prior to joining The Catholic University of America, Bill served as Senior Counsel with Americans United for Life for a decade.

Katie Glenn on Dobbs v. Jackson Women's Health, the U.S. Supreme Court case that could protect preborn children

The U.S. Supreme Court recently announced that it would hear a new case later this year from the state of Mississippi. Dobbs v. Jackson Women's Health concerns a protection for pre-born children beginning at 15 weeks gestational age. If the Supreme Court upholds Mississippi's pro-life law, it would be the most meaningful victory in decades in the fight to advance the human right to life.

Katie Glenn, Government Affairs Counsel at Americans United for Life, joins Tom Shakely and Noah Brandt to discuss why the Supreme Court took up this case, how they may rule, and what it could mean for life across America.

Senator Steve Daines on founding the U.S. Senate pro-life caucus, the people of Montana, and abortion at the Supreme Court

For too long, pro-life concerns have taken a backseat to other issues by politicians who were elected in part because of the hard work of pro-life advocates. Only in the last few years have a few leaders stepped up to the plate to put the human right to life at the forefront of the public policy agenda.

Senator Steve Daines, of the great state of Montana, founded the pro-life caucus in the United States Senate to ensure that lifesaving legislation is advocated for and fiercely defended in Congress.

Sen. Steve Daines joins Tom Shakely and Noah Brandt to speak on his work in the Senate, the success of the U.S. Senate pro-life caucus, and the latest opportunity before the Supreme Court to protect life.

Congressman Henry Hyde on supporting mothers and families, standing up for the powerless, and partial-birth abortion

Congressman Henry Hyde became the namesake of the Hyde Amendment, which prohibits the use of federal taxpayers dollars from financing abortion businesses. The Hyde Amendment has for decades ensured that no American would be implicated in the tragedy of abortion via taxpayer support.

"Hyde" has always been more than a buzzword or a policy idea. Hyde was a real man, who had an impact on America so substantial that we are still wrestling with his vision and the consensus against needless abortions today.

Congressman Hyde’s work couldn't be more relevant today, as many politicians, even those who formerly supported the Hyde Amendment have now turned away and embraced the promotion of abortion and taxpayer dollars. Now more than ever, it’s vitally important to hear from the man behind the Hyde Amendment himself, since the drama of the $1.9 trillion COVID-19 relief bill became the first spending bill since 1976 without Hyde Amendment protections.

Fortunately, Congressman's Hyde’s remarks to Americans United for Life in the late 1990s remain fresh and instructive. We hear from Congressman Hyde himself on the need for enlightened Americans to support mothers and families facing unexpected pregnancy, the vital importance of pro-life work against abortion, and the realities of partial birth abortion.

Lois Anderson on Oregon’s experience with suicide, the false promise of 'protective guidelines,’ and practicing solidarity

Lois Anderson on Oregon’s experience with suicide, the false promise of 'protective guidelines,’ and practicing solidarity

Oregon has been America's grim national leader on the issue of suicide since 1994, when Oregonians voted 51% to 49% to make suicide lawful by means of a physician-furnished lethal overdose. Since the lifting of a 1997 injunction that had delayed the availability of physician-prescribed self harm for Oregonians, thousands have died from suicide by overdose.

Every life lost has come at least partially as a result of the lie that suicide can be medicinal—as if physicians or so-called caretakers administering a fatal overdose could call that deadly act “healthcare”. What was true yesterday remains true today—the role of the physician is never to intentionally cause harm—it is, rather, to heal and to cure.

Lois Anderson, Executive Director of Oregon Right to Life, joins Tom Shakely and Noah Brandt to share Oregon's experience with suicide and lessons from the front lines of Oregon's suicide prevention efforts, her work with Oregon Right to Life across the spectrum of issues, and how advocates everywhere can protect those in their communities who most at risk to forms of self-harm and violence.

Dr. Leon Kass on the hubris of human reproductive cloning and the threat of radical forms of child abuse

“Should we welcome, or even tolerate, the cloning of human beings?” That is the question with which Dr. Leon Kass, M.D., Ph.D. opens his speech at a conference focused on coalition-building hosted by Americans United for Life in 1998. Dr. Kass covers the science, morality, and human rights concerns underpinning the debate on the ethics of human reproductive cloning—the attempt to make copies of the human person.

As Dr. Kass puts it, “We have to decide nothing less than whether human procreation is going to remain human, whether children are going to be made rather than begotten, and whether we wish to say yes to the road that leads to the dehumanizing hell of brave new world.”

Dr. Kass served as the Chairman of the President’s Council on Bioethics from 2001 to 2005 and has been engaged for more than 40 years with ethical and philosophical issues raised by biomedical advances and, more recently, with broader moral and cultural issues. His most recent book, “What So Proudly We Hail: The American Soul in Story, Speech, and Song,” seeks to promote American identity, character and citizenship.

Dr. Kass’s evergreen remarks, delivered nearly a quarter century ago, remain fresh and relevant. Dr. Kass lays out how to avoid what he terms the “Frankenstein-ian hubris” of those who would promote reproductive human clones.

Introducing 'Unsafe,' America's most comprehensive research investigation into the abortion industry

We’re proud at Americans United for Life to share “Unsafe: America’s Abortion Industry Endangers Women," a 50-State investigative report on the dirty and dangerous abortion industry. Unsafe tells the story of how the abortion industry bet everything on a strategy of total repeal of the nation’s abortion laws, believing against the evidence that abortion would be safe if it were just made legal. America’s women lost that bet—big time—when the U.S. Supreme Court struck down abortion laws in all 50 states in Roe v. Wade.

Unsafe is most comprehensive research investigation of abortion industry inspections ever conducted—it’s the most documented record of the tragic consequences of Roe v. Wade that exists.

Unsafe reveals the reality of conditions in abortion businesses, documenting that more than 300 facilities in 39 states were cited for more than 2,400 health and safety deficiencies between 2008 and 2020, including hundreds of significant violations of state laws meant to ensure basic health and safety.

Tom Shakely and Noah Brandt speak with two of the authors behind "Unsafe:" Steve Aden, Chief Legal Officer & General Counsel at Americans United for Life and Katie Glenn, Government Affairs Counsel, on the sorry state of the abortion industry and what we can do to protect mothers and their children.

Dr. Chad Pecknold and Josh Craddock on the Lincoln Proposal and correcting Roe's first and foundational error

Dr. Chad Pecknold and Josh Craddock on the Lincoln Proposal and correcting Roe's first and foundational error

Since 1973, more than 60 million American children have been killed by the violence of abortion. The horror of approximately 2,000 daily killings stems from the United States Supreme Court’s constitutional errors in Roe v. Wade. The Court made two fundamental errors in Roe: first, in its refusal to read the Fourteenth Amendment’s guarantees of equal protection and due process to extend to preborn persons; and second, in its erroneous conclusion that “the right to privacy extends to abortion.”

Fortunately, as scholars ranging from Professor Robert P. George to Professor Mark Tushnet have observed, the judiciary is not the sole interpreter of the Constitution. Rather, the legislature and executive share in this responsibility. Since Planned Parenthood v. Casey, the judicial and legislative branches, as well as the states, have engaged in a kind of trench warfare over the logic and scope of Roe’s secondary error. The Lincoln Proposal, co-authored by Catherine Glenn Foster, Dr. Chad Pecknold, and Josh Craddock, offers a bold vision to repair our constitutional order by turning the executive’s attention to the task of correcting Roe’s first and foundational error.

We speak with Dr. Chad Pecknold and Josh Craddock on their “Lincoln Proposal” and how— regardless of whatever lingering indifference exists from our legislative or judiciary classes—future pro-life presidents should act to protect pre-born persons.

Jack Gorby on the early days of Americans United for Life, Roe v. Wade and strategies to advance human rights, and the future

Before Roe v. Wade, the U.S. Supreme Court did not function as if it were America's National Abortion Control Board. Instead, the issue of abortion was left America's voters and their elected representatives across the states. As Roe was being handed down and the violence of abortion was being imposed across America, human rights advocates came together in the 1960s and '70s to fight the scourge of nationalized abortion. Jack Gorby, a co-founder of Americans United for Life, was one of those human rights advocates who was there at the beginning of America's most contentious culture war issue. In addition to his role with Americans United for Life, Jack is an accomplished attorney and professor emeritus at John Marshall Law school. Jack joins Tom Shakely and Noah Brandt to reflect on his role in the fight against abortion from Roe through to the present.

Hadley Arkes returns to "Life, Liberty, and Law" with Tom Shakely and Noah Brandt to talk originalism, the U.S. Supreme Court under Chief Justice John Roberts, and the principles and moral sensibilities that lie beyond the Constitution's text. David French and Josh Craddock have joined "Life, Liberty, and Law" previous to talk on originalism and textualism, and as the debate over the practical usefulness of originalism intensifies, Hadley contributes to this important conversation. Hadley also discusses the possibilities for pro-life law and policy in light of what appears to be a U.S. Supreme Court increasingly comfortable with (call it whatever you want) forms of judicial supremacy and judicial activism and the threat SCOTUS's continuing evolution into a sort of super-legislature. Hadley Arkes is an author, professor, and political scientist. Hadley is professor emeritus at Amherst College and is founder and director of the James Wilson Institute on Natural Rights and the American Founding.

Katie Glenn on abortion as a business and the push for abortions in your home

Katie Glenn on abortion as a business and the push for abortions in your home

What have you been up to these last few months? While most of us have been confined to our homes, life may have taken on a slower pace than we are used to. But that slower pace certainly isn’t the case for everyone. Who has been more active than ever? Abortion businesses. Abortion, Inc. has been so busy in part because it has been fighting to reverse life-affirming safeguards in order to send abortion drugs through the mail. Katie Glenn, Government Affairs Counsel with Americans United for Life, joins Noah Brandt for a conversation on how we can fight back against the abortion lobby's attempt to bring abortion into the home.

The role of the U.S. Supreme Court, Brown v. Board of Education, and Roe v. Wade

The role of the U.S. Supreme Court, Brown v. Board of Education, and Roe v. Wade

What is the role of the United States Supreme Court? What is "settled law"? And how does the Supreme Court attempt to rectify its wrongs? These questions and more were at stake when the Supreme Court issued its unanimous opinion in Brown v. Board of Education on May 17, 1954. In Brown, the Supreme Court finally acknowledged the moral evil and legal fiction that was state-sanctioned segregation of the races. To get to that critical decision, the Supreme Court had to reverse itself on a prior ruling that had guided the nation for more than 50 years, Plessy v. Ferguson. The Court's courage in reversing its precedent and in charting a new course offers a heartening beacon of light, illuminating the path that could reverse erroneous Court precedent set in Roe v. Wade. Steve Aden, Chief Legal Officer & General Counsel at Americans United for Life joins Clarke Forsythe, Senior Counsel, and Noah Brandt on "Life, Liberty, and Law".

Michele Menke on pregnancy resource centers, offering mothers and fathers real choice, and post-abortion recovery

Michele Menke on pregnancy resource centers, offering mothers and fathers real choice, and post-abortion recovery

If a woman chooses abortion because she feels she has no other options, has she made a free choice? Planned Parenthood and other abortion businesses exist to push one choice in response to unexpected pregnancy: abortion. But America has thousands of pregnancy resource centers that exist to help women seeking choices other than abortion. Truly, pregnancy resource clinics make it possible to plan parenthood.

Who are the people making real and life affirming choice as possible for those mothers who may feel they have no other choice than abortion? They’re not being run for profit, like some abortion businesses, and they’re not generating hundreds of billions of dollars in taxpayer funding, like Planned Parenthood. They're run by everyday hometown heroes, women and men who volunteer their time out of love and in the spirit of solidarity to change lives for the better.

Michele Menke, RN Manager of Hand 'n Hand Pregnancy Help Center, joins Tom Shakely and Noah Brandt on "Life, Liberty, and Law". Michele is one of America’s everyday heroes, offering real choice to those in need. Michele shares with us what it’s like to help women make life-affirming choices, and also shares with us her life story as a wife and mother of five who has overcome the trauma and violence of abortion.

Dr. Aaron Kheriaty on America's pandemic response and the frontline realities confronting our physicians and medical personnel

We’re bracing in America for the coronavirus to impact our cities and communities in waves. We are living in a new normal, and this virus is not going away. As we grapple with how best to mitigate the deadly consequences of this new normal, our frontline physicians and medical personnel are facing life-and-death questions about how to deliver the best care possible given limited and sometimes even non-existent essential resources. And there are a host of ethical questions that must be navigated to ensure we don’t needlessly sacrifice human lives or surrender to inhumane forms of rationing, denial of treatment, or simply cultural indifference to those who are most vulnerable.

Dr. Aaron Kheriaty stands at the intersection of these issues and is one of America’s frontline physicians confronting this crisis. Dr. Kheriaty is Director of the Medical Ethics Program at UCI Health in Southern California and serves as chairman of the medical ethics committees at UCI Hospital and at the California Department of State Hospitals. Dr. Kheriaty joins Tom Shakely to share a physician's perspective on America's pandemic response and more.

Johnny Burtka on cultural change, The American Conservative, and America post-pandemic

Johnny Burtka on cultural change, The American Conservative, and America post-pandemic

As we live through this pandemic, we are in some sense able to look ourselves in the mirror and discover what sort of lives we’re living—and if we’re finding ourselves happier and more fulfilled with the content of our lives today than we were yesterday, this is a time for thoughtful reflection about what we will do improve things post-pandemic. And we’ve got a chance to do this not only individually and in our families, but also as a nation. Who do we, as the American people, want to become in a post-pandemic world? And what cultural changes might have already been underway, but which we might find accelerated in the months and years to come? Johnny Burtka, Executive Director and Acting Editor of The American Conservative, joins Tom Shakely and Noah Brandt to consider these questions and more.

Dr. Chad Pecknold on solidarity amidst pandemic, the nature of the common good, and post-liberal conservatism

As we live through this time of pandemic in the life of America and the world, many of us find ourselves grappling with questions at the heart of the human experience. What does it mean to live a good life? Am I spending my time in the best way possible? How can I help build a better life for my family, my loved ones, my community? And what does it mean to protect life when all of us find ourselves vulnerable, even powerless? Dr. Chad Pecknold, Associate Professor at the Catholic University of America and Fellow at Catholic University’s Institute for Human Ecology, joins Tom Shakely and Noah Brandt to consider these issues of human life.

As the coronavirus pandemic continues to grip America, governors and other authorities are ordering all non-essential businesses and services shuttered. Restaurants, barber shops and salons, clothing stories, government offices, and even churches have closed for the benefit of the public. But what about abortion centers? In the minds of abortion activists, the intentional killing of children is always the most important issue—even in a time of international pandemic. Steve Aden, Chief Legal Officer & General Counsel at Americans United for Life, Katie Glenn, Government Affairs Counsel, and Clarke Forsythe, Senior Counsel, join Tom Shakely and Noah Brandt to talk about it in this special episode.

"A fetus that was born." Incredibly, these five words were used by CNN to describe a human baby in its reporting on Sen. Ben Sasse's "Born-Alive Abortion Survivors Protection Act". Though it earned bipartisan support, the bill failed in the U.S. Senate. It would guarantee that children who survive abortion cannot be allowed to die as a result of neglect by physicians. Tom Shakely and Noah Brandt reflect on CNN's reporting and the facts of the law in this special episode.

Clarke Forsythe on 'Abuse of Discretion: The Inside Story of Roe v. Wade' and the fiction of abortion rights

Clarke Forsythe on 'Abuse of Discretion: The Inside Story of Roe v. Wade' and the fiction of abortion rights

Clarke Forsythe, Senior Counsel at Americans United for Life, joins Noah Brandt to discuss his book "Abuse of Discretion: The Inside Story of Roe v. Wade" and the fiction of abortion rights as a matter of constitutional law. Although people have heard the phrase "Roe v. Wade," polling shows that very few Americans can explain what Roe means. Roe set the United States on a radical course, making America one of just four nations in the world that allow abortion for any reason after viability—the point at which a human person would otherwise survive without the support of her mother. Abortion continues to roil America because of the U.S. Supreme Court's errors in its 1973 Roe v. Wade decision, and our body politic will continue to suffer until the Supreme Court reverses Roe and returns the issue to the American people through the democratic process.
