The House special committee's report was released in the final days of 2022 with the recommendation that the now Republican-controlled Congress bar Trump from ever holding office again, as well as be criminally prosecuted. Sam Goldman interviews Andrew Seidel, a constitutional and civil rights attorney and the author of two books: The Founding Myth: Why Christian Nationalism Is Un-American and American Crusade: How the Supreme Court is Weaponizing Religious Freedom. He's also co-editor of an academic text, Law and Religion: Cases and Materials 5th Edition, with Prof. Leslie Griffin of UNLV law school. Andrew is a Senior Correspondent at Religion Dispatches, a prolific author of opeds and scholarly articles. He organized and contributed to the groundbreaking report “Christian Nationalismat the January 6, 2021, Insurrection,” which was published by the Baptist Joint Committee and FFRF and which aroused congressional interest. In this situation, there is continuing danger and positive potential for the people to weaken a fascist leader and movement. But left on its own, without a mass showing of opposition to what Trump stands for, it will not be enough.  Trump and his GOP have been incredibly resilient, finding opportunities to turn their "defeats" into opportunities for further hardening of a fascist core. Look at how his supporters are responding to the raid. Every setback he has weathered has led to more vengeance and violence. This is a key lesson of January 6th.  There is no lack of evidence against Trump. But the problem w/ Trump & Co has never been finding the stuff. There is if anything a glut of evidence. That he still leads his movement despite all this evidence is part of why he is so effective and celebrated.  Right now, the corrupt ex-president of S. Korea is serving a 20-year sentence. In 2016 and 2017, it took 20 successive Saturday night rallies bringing 16 million into the streets to get her impeached. She was arrested shortly after being driven out of office.  Trump and his GOP are planning Coup 2.0. If we allow that to go down, they will be all out for revenge and the stakes for humanity will be exponentially higher.  Fascism can & is happening here & it can't simply be voted away. Relying on official channels, on voting alone, on the Democrats to remedy this instead of taking to the streets in a sustained way has led to inaction & conciliation with fascism. The question remains, what will the decent people do? Over the past couple weeks SCOTUS has issued a series of rulings that flag that they are no longer concerned with the appearance of legitimacy: rights no longer need to be read to people arrested by the police, states cannot issue laws restricting who can conceal guns, and the EPA cannot prevent power plants from filling the air with pollution. They also agreed to hear a case that would enable state legislatures to conduct elections according to whatever procedures they set... and of course overturned the constitutional right to abortion, setting in motion the chaos we're seeing across the country as clinics shut down and patients, including a 10 year old rape victim from Ohio, have had to travel great distances to obtain access to abortion. "Highlights" from this week in fascism and future coup attempts (recommended reading: Trump’s Next Coup Has Already Begun) including the “options for January 6” PowerPoint uncovered by the January 6 commission and Matt Gaetz on Steve Bannon's podcast this past Thursday. Gaetz said an "army of patriots" should get ready now to "fight" for the US - Bannon said "shock troops" divided into teams could take over some 4,000 government positions. This is three things: a threat, a strategy, and also an exposure of what happened the first time around. Then, Sunsara Taylor (The RNL Show) on the moves to overturn Roe v. Wade and a conversation with an Ann Arbor based activist who traveled to the Michigan State Capitol on Dec 1 to shut down the State Legislature and sound the alarm on the emergency for abortion rights. But it’s meaningless to simply state that without backing it up. The history of fascism has shown us that dominating the public square and the public discourse – whether or not they have majority opinion on their side, goes a long way in determining whether fascism prevails or not. Follow Coco Das on Twitter at @Coco_Das and Paul at @Streetwriter17 We’re continuing to pay special attention to the three trials with tremendous stakes:  In Charlottesville, Virginia: The federal civil trial of 24 white supremacist groups and individuals who came to Charlottesville in August 2017 and unleashed fascist violence that led to the murder of Heather Heyer.  In Brunswick, Georgia: the case against Gregory McMichael, Travis McMichael, and William Bryan who are on trial for hunting down and murdering Ahmaud Arbery, an unarmed 25-year-old Black man who was out on a jog.   And in Kenosha, Wisconsin: The criminal murder trial for Kyle Rittenhouse who traveled with an AR-15 to a Black Lives Matter protest in Kenosha where he shot and killed two protesters and wounded another.  All three concentrate the fascist mobs and threats of violence that are being unleashed to build the fascist movement and consolidate power & it reflects the ways in which there is an assault on the rule of law in this country and the most vicious overt white supremacy that threads it all together.  ALSO: Penn America released a report this week exposing what they are calling educational gag orders that outline how lawmakers in nearly half the country this year have tried to muzzle educators in regards to topics that include racism, sexism, and American history. As detailed in the report from January to September, a total of 54 bills concerning K-12 schools, higher education institutions and state agencies were introduced, the report says. Eleven of those bills have become laws in nine states, including Texas, Tennessee and Oklahoma. The danger is real that Republican legislatures in states like Arizona, Georgia, Texas erect enough barriers to the ballot and destroy enough democratic norms their party simply cannot lose a close race. Freespeechforthepeople.org is urging Attorney General Merrick Garland to resign from his post after nine months of inaction to hold Trump and his allies accountable for inciting the January 6th insurrection and other federal crimes they may have committed. It’s good that people are refusing to accept this accommodation to fascism. That said, it’s time for people to recognize that it isn’t just one or another individual doing this - but that ‘democratic’ norms, institutions, and the Democratic Party can’t be relied on to handle this threat.
