Recognising the fundamentals of Nigerian fashion law

Recognising the fundamentals of Nigerian fashion law

Nigerian fashion law covers a wide range of legal topics, including contract law, consumer protection, and intellectual property. Designers and other professionals in the fashion business should be aware of these legal foundations to safeguard their intellectual property, follow laws, and avert legal issues. Trademark registration, copyright protection, license agreements, and adherence to norms and regulations for product safety and labeling are a few important factors to take into account. Getting legal counsel from a skilled expert might also be helpful.

For episode 102 Bernice Asein Lead Counsel, Cardinal Counsel, and Founder of Fashion Law Institute, Nigeria shares her insight on what the Fashion business in Nigeria is like.

Genericity of a Trademark: Ellu P Short Shelf Life of Distinctiveness

Genericity of a Trademark: Ellu P Short Shelf Life of Distinctiveness

Following the popularity of the term "ELLU P" which was birthed during the just concluded presidential election, it raises questions on the rights of an unregistered trademark owner who stands the risk of his mark being misused for commercial purposes, straying from its function as a trademark, losing its distinctiveness and Losing a trademark before (registration) you even begin using it for commercial purpose. In episode 94 of the IPSERIES podcast, I discuss the implication of a trademark becoming generic, the defense to a trademark infringement suit, intellectual property considerations for creatives who want to do merchandise, and the possibility of it becoming generic from being overused, among other things. The spring up of other products and collaboration between a Twitter user @leyeconnect who happens to be a designer and the originator of the phrase "ELLU P" inspired today's #IPSERIES post. Observing the Trademark Distinctiveness Criteria as a Fashion Brand in Nigeria and Africa

Observing the Trademark Distinctiveness Criteria as a Fashion Brand in Nigeria and Africa

The innovation associated with a fashion brand is preserved via trademark and intellectual property mechanisms. An essential condition for trademark registration is distinctiveness. To steer them clear of the concerns with infringement and counterfeiting, the fashion firms' unflinching inventiveness is kind of a test.     In episode 90 of the #IPSERIES podcast, I analyzed the role of a registrar, pertinent intellectual property rights, grounds for trademark invalidation application, trademark dilution, and many other factors in the case of Thom Browne's victory over Adidas over his four-stripe motif against the vase of Louis Vuitton losses the checkerboard patterns aka Damier Azur following a petition for invalidation by Mr. Norbert at the EUIPO. What a copyright infringement case is worth in Nigeria.

What a copyright infringement case is worth in Nigeria.

A copyright infringement case can have a variety of outcomes, depending on the specifics of the case. Generally speaking, a successful claimant may be entitled to monetary damages, injunctive relief, and/or attorneys' fees.  The number of damages that a claimant may receive will depend on several factors including the number of profits that the infringer made from the infringement, the number of damages caused to the copyright holder, and the relative sophistication of the parties.  See the link to listen to episode 89 and don't forget to share with creatives within your network: https://anchor.fm/rita-chindah/episodes/What-a-copyright-infringement-case-is-worth-in-Nigeria-e1ti16j You can subscribe to my newsletter via this link-  https://ipseries.substack.com Instagram: https://www.instagram.com/ipseries_with_reedah  Twitter: https://twitter.com/IPSERIES1 Facebook: https://www.facebook.com/groups/836484013662125/?ref=share Send me a voice message: https://anchor.fm/rita-chindah/message You can read the Twitter version here: https://twitter.com/ESMERALDOANWIRI/status/1615016525756502016?t=nvyRonPs1qycx31lY8PFAw&s=19 You can read the LinkedIn version: https://www.linkedin.com/posts/rita-anwiri-chindah-aciarb-aidr-3347b472_unauthorized-use-of-ip-by-telecom-companies-activity-7020661157552099328-iWlQ?utm_source=share&utm_medium=member_android  #podcast #podsinnaija #africanpodcast #ipr #intellectualpropertypodcast #nigerianpodcastnetwork #africanpodcast  #nigerianpodcast #nigerianpodcastnetwork  #africanpodcast #nigerianpodcast #nigerianpodcaster #podcastinAfrica #podcasting

Family x Intellectual Property: Ali v Ali; Luka99, Inc v Mirjam Poterbin, EWN v ECSWM

The interplay of Family and Intellectual Property rights allows a family business to protect their economically valuable intangible assets".

When the trademark opposition is too close to home, what do we do? In this episode I discuss 3 cases which highlight the interference of a family member regarding owning an intangible asset.

Our case study for episode 82 of #IPSERIES features a dispute emanating from the opposition of a trademark application and an already registered trademark being challenged on grounds of abandonment.

In the first case of Muhammed Ali v Laila Ali, the daughter of the late American Professional boxer application to trademark her name was opposed by the licensing company who had bought the trademark, name and likeness of Muhammed Ali.

The second case features a dispute between a mother and her son who happens to be a 23 year old professional basketballer over his name "LUKE DUNCIC" . What would be the fate of this case which is too close to home?

The final case happens to be a dispute on trademark opposition from a former business partner who is opposing the use of a family business name "ENG's that has been in existence since the 1960's.

Why you can not COMMERCIALIZE a gift or can you?

Today's #IPSERIES is a #tbt edition featuring the case my friend @gingerPOP_ sent to me about a potential IP theft where Jane Michael Ekannem's kimono which she gifted to Laolu was worn by Serena William for the Essence 2019 September issue & and she was neither paid nor acknowledged. I delve into this case by taking into consideration whether it is right to reproduce and sell clothing that was gifted to you by a fashion designer or let's say a creative or innovator. Trade Secret/Confidential Information as the subject matter of an intangible property.

Sometime in 2006 the Federal Government opened bidding for the national ID project which Chams Plc emerged as the winner. Chams Plc will then go into a technical partnership arrangement with Mastercard Asia/Pacific Pte Ltd in 2012 but MasterCard played a fast one on Chams Plc and CCL by going to collide with National Identity Management Commission (NIMC).

In episode 76 of the #IPSERIES podcast #throwback edition, I discuss the benefits of exploring trade secrets for your business as an intellectual property mechanism, available remedies, challenges and limitations of trade secret protection, and many more.

Grounds for Invalidating/Cancelling a Trademark: Lessons from Shakira v Shakara case

Did you know Shakira's partial recently won a case at the UKIPO over the name "Shakara" meaning at the moment in the UK you can't use the word "Shakara in Class 25 because Steve Uzoma Nwankpa surrendered it to her this year? Anyways in episode 69 of #IPSERIES podcast, my commentary about the case and what the grounds for invalidating/cancelling a trademark is discussed.   In your opinion do you think the word "My Shakara" which was owned and used by a Nigerian Steve Uzoma Nwankpa before he surrendered it to Shakira was the right thing? How about the registry directing the word can't be owed by anyone especially when it's been considered to be a common word in Nigeria. Abi our #Shakara know reach Intellectual Property? Is the sign "Shakira" owned by Colombian singer and songwriter Shakira Isabel Mebarak similar or identical to Steve Uzoma Nenkpa's "MyShakara" since they both registered in Class 25 for clothing, footwear and headwear for human beings?      You can subscribe to my newsletter via this link-  https://ipseries.substack.com Instagram: https://www.instagram.com/ipseries_with_reedah  Twitter: https://twitter.com/IPSERIES1 Facebook: https://www.facebook.com/groups/836484013662125/?ref=share Send me a voice message: https://anchor.fm/rita-chindah/message Twitter version https://twitter.com/esmeraldo99/status/1545113584643997696?t=5uJFaMZfjXV9HcSU4eOuzg&s=19

Intellectual Property Guidelines for Film Fan Makers

Millicent Umoru LL.B, B.L, ACIS (In-view)  tagged me to a link and asked for my view on a matter that was viral on Twitter with the hashtag #justiceforspongbob.    I read through the post and discovered that a fan of #spongebob had recreated a movie called SpongeBob SquarePants: Rehydrated and it was taken down from YouTube for Copyright Violations after a complaint was field by #ParamountPictures hence the outrage.    My initial thoughts were that maybe PencilWorkshop and his team were guilty of it but as I began my research on the case I got to learn a lot about the intellectual property rights in animations, a guideline for fan films, more about how YouTube takedown notice works, how best to classify the act etc    Today's #IPSERIES is a commentary on the #justiceforspongebob case with a brief comparison of the US and Nigerian copyright systems.    Did you watch any of the SpongeBob SquarePants Movies?     The movie has been restored back on YouTube and now has 1.6 million views in a month so you can check it out.     Are you a fan?  You can subscribe to my newsletter via this link-  https://ipseries.substack.com Instagram: https://www.instagram.com/ipseries_with_reedah Twitter: https://twitter.com/IPSERIES1 Facebook: https://www.facebook.com/groups/836484013662125/?ref=share Send me a voice message: https://anchor.fm/rita-chindah/message Twitter version :https://twitter.com/esmeraldo99/status/1533852120222515200?t=Ye3TLXayriKCrIa2TfsUPw&s=08  #intellectualproperty #podcast #film #movie

What Disc Jockeys (DJs), Event Organisers & Venue owners need to know about copyright

In celebration of World Music Day here is the podcast version of the social media call-out made by Timi Dakolo against the All Progressive Congress (APC) over the use of his song "Great Nation" and other artists' songs at the #APCPresidentialPrimaries without their permission,  In this episode, I highlight what Disc Jockeys (DJs), event organisers and venue owners need to know about copyright, how it affects the music industry, licensing the music industry, if you are in the business of music, inherited rights, contributory infringement, copyright law applies to you and what to do in the event of a dispute what a copyright owner is expected to do by opting to litigate or explore an alternative dispute resolution mechanism (ADR). What are your views about this development?  Does #TimiDakolo has a case against APC or the DJ or the event centre? Does it meet the fair dealing principle requirement?
