The ball of your foot and the press of your toes are two different techniques. He used his toes rather than the ball of his foot which shows in the manual. Using the ball of your foot would restrict weight. Using your toe creates force to the knee on your neck. It was not proper procedure.

An Example: Had his "Public Defender" had said this, he may had been found not guilty or perhaps a lesser charge.

Let's say he was saying something good from the Bible loudly and irritating people enough to assault him. Would it still have been murder? A bias prosecution at best. But it's typical.
